78.1 (1) No person shall drive a motor vehicle on a highway while holding or using a hand-held wireless communication device or other prescribed device that is capable of receiving or transmitting telephone communications, electronic data, mail or text messages. 2009, c. 4, s. 2. It doesn't matter that it wasn't to your ear. You don't need to hold your phone up to your ear to text message, check your email, go on the internet, or do whatever you do. Using your phone as an audio device is also prohibited if the basic controls can't function without using the normal buttons on your vehicle.

The options are on the back of your ticket. You can either (1) Plead guilty (2) Go to a first attendance meeting where you will still be asked to plead guilty, but they may give you a reduced fine, or (3) go to trial.

If the improper brakes are under S. 64 of the HTA, then both tickets don't carry demerit points. Option 2: the crown will most likely drop one of the tickets and have the other ticket's fine reduced. You may have to show that you fixed the brake system through a work-order or some pictures. If you choose to plead guilty to both or one of the tickets, they will show on your driving record and could possibly affect your insurance premiums depending on your policy. You have an opportunity to show financial difficulties (unemployed, dependents, welfare, homeless) with the JP to reduce your fine even further and request extra time to pay, even a monthly installment arrangement. In Brampton, the crown will most likely withdraw both tickets if the officer is a no-show. http://www.e-laws.gov.on.ca/html/regs/e ... 0339_e.htm

I was downtown for the Brasil game and was sad they lost and even futher when i came out and saw my vintage vehicle had been hit.

I have made a very similar careless mistake as the young man in this post - www.ontariohighwaytrafficact.com/topic3580.html - i have passed three cars and in the process got caught speeding at 160 kmh. I totally understand passing is no exception to speed, i was being careless. I was talking…

first post on this forum. When I received a speeding ticket last week, I realized the vehicle permit had my former address. At the time I was surprised since I remember changing address at a Kiosk(maybe it was just for my license).
Received a +$85 ticket for incorrect address....OHTA 9(2).
If you look close enough, beside the drivers' side "A" pillar you will see a white circle = front antenna of Genesis radar......plus look above the dash pad...there is the Spectre RDD.
I got a ticket yesterday night at 11:50PM at McNicoll and McCowan, for failing to stop at the red stop light. The officer behind me (a little careless of me not to check, but my mirror is in bad shape) pulled me over after I had crossed the intersection. I approached it on yellow, and while I was…
Interesting article from a licensed paralegal about the new Stunting Laws, and what's actualy happening in the courts, and what options you have if you get this charged:
It is respectfully submitted that coupling absolute liability offences with the punishment of imprisonment violates s. 7 of the…
I got a ticket last February for holding an iPod Touch while stopped for a traffic light. I was using a GPS app on iPod Touch 4G, and I was charged under 78.1(1) which is for hand held wireless communication device, but clearly an iPod Touch falls under section 78.1(2) as it is an entertainment…
Got a ticket for an expired sticker while skiing in Gatineau Park. No warning, just 451$ in the mail 3 weeks after the incident.
I understand this is common, and frustrating. Had the sticker in the car, am ready to go to court to explain and was going to send back the notice yesterday to request a…
