Terms of Service
These Terms of Service (“Terms”) govern your access to and use of OntarioHighwayTrafficAct.com / “OHTA.ca” (the “Site”), including our forums and related services (collectively, the “Services”). By accessing or using the Site, registering an account, or posting content, you agree to be bound by these Terms.
1. Acceptance and Related Terms
These Terms are intended to work together with our Privacy Policy, our Disclaimer, and the forum software terms available at Terms of Use. If there is a conflict between these Terms and any other site notice, these Terms control to the extent permitted by law.
Advertising, analytics, and cookies. The Site may display advertisements and may use cookies and similar technologies for essential forum functions (such as login, security, and preferences) and, where enabled, for analytics and advertising measurement and personalization. We describe these practices and your choices (including how to manage or withdraw consent for non-essential cookies) in our Cookie Policy section of the Privacy Policy.
2. Eligibility and Accounts
The Site is intended for individuals aged 13 or older. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
3. Forum Conduct and Acceptable Use
You agree not to use the Site to post or distribute content that is unlawful, harmful, deceptive, abusive, or that violates another person’s rights.
- Do not post content that is defamatory, harassing, hateful, or that invades privacy or discloses personal information of others without consent.
- Do not post content that infringes intellectual property rights.
- Do not attempt to hack, disrupt, or abuse the Site or its users.
- Do not use the Site for spam, unauthorized promotions, or malicious automation.
4. User Content, Public Nature of Posts, and License
You retain ownership of content you post (“User Content”), but by submitting User Content you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license (with the right to sublicense) to host, store, reproduce, display, distribute, and adapt your User Content as necessary to operate, maintain, secure, moderate, and improve the Services.
AI and product development using non-identifying content. Where feasible and appropriate, we may use aggregated, de-identified, and/or otherwise non-identifying versions of public User Content to develop and improve features and tools across the Site and our related products and services (our “Network”), including (without limitation) search and discovery tools, spam and abuse detection, moderation assistance, AI chatbots, AI-powered summaries, recommendations, and other automation.
- We may process, analyze, and transform public User Content for research, statistical, quality-assurance, and product-improvement purposes, including training, fine-tuning, and evaluating machine-learning and AI models used by us or by service providers acting on our behalf.
- We will take reasonable steps to minimize the amount of personal information used in these workflows and, where appropriate, apply de-identification techniques. If you include personal information in public posts, that information may remain visible to others.
- We do not use automated processing to make decisions that produce legal or similarly significant effects about you based solely on automated processing, except to the extent permitted by applicable law and with any required notice/consent.
You may request that we exclude your future public posts from certain internal AI training or product-development workflows where feasible. It may not be technically feasible to remove the influence of content already incorporated into aggregated datasets, analytics, or trained models.
5. Moderation and Enforcement
We may remove, edit, move, or restrict access to content or accounts at our discretion. We do not guarantee that we will monitor all content.
6. No Legal Advice and Disclaimer of Warranties
The Site is for general informational discussion only. Nothing on the Site is legal advice. The Site is provided on an “as is” and “as available” basis without warranties of any kind.
7. Limitation of Liability
To the maximum extent permitted by applicable law, the Site Parties (meaning the Site owners, operators, administrators, moderators, staff, and their affiliates, officers, directors, employees, and agents) will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages. If we are found liable for any claim, our total aggregate liability will be limited to the greater of CAD $100 or the amount you paid to access the Site (if any).
8. Indemnity
You agree to defend, indemnify, and hold harmless the Site Parties (including the Site owners, administrators, moderators, and staff) from claims arising out of your use of the Site or your User Content.
9. Governing Law
These Terms are governed by the laws of Ontario and the applicable federal laws of Canada. You agree to the exclusive jurisdiction of the courts located in Ontario.
