so... a ticket was given "drive motor vehicle no license" contrary to "highway traffic act 32(1)" no notice from the dmv was issued thru the mail (yes, it is the license holders responsibility). but, i did have a license. it was just expired... and the 32(1) says that it's for a person driving a class of vehicle to which they dont have a license for. again, there was a license, just expired. should the ticket be taken to the JP/prosecutor and pleaded for less? (ie: no surrender), or is it a losing battle? hire represenation? thanks!

Driving with an expired licence is "drive with no licence." The charge is correct. You could try to plea bargain to something less. Provided that you show proof that you've renewed your licence, the Prosecutor may go for it (no guarantees obviously).
