My wife was just pulled over for running a yellow light and instead was ticketed for an expired drivers licence. The license expired on her birthdate 4 months ago and she didn;t recieve a renewal. $325 !!!!!! Hope someone can help. She was ticketed under HTA 32 (1) with the offense shown as "Drive Motor Vehicle no license" Can anyone tell me if this is worth the effort to get a reduction in the amount of fine? Is it proper that she was charged with NO license instead of an "expired" license? Thanks for your help on this.

Once your licence expires you no longer have a licence to drive, therefore you are driving without a licence. A little blessing in it all.....I have yet to hear of an insurance company covering any costs of a collision for a driver with an expired licence as they don't have a licence to drive. I have seen coverage if you are hit by an unlicenced driver.

Thanks highway bear  .....you're obviously a cop ... I already know what a cop would say and how they think..... very black and white ....that's why my wife has a ticket.... and shows that you've followed your step by step manual to a "T".... you've sure memorized your manual very well. Now let's get back to the real world ....What I was hoping for was an unbiased opinion .... I already have the cop's point of view on the ticket .... I don't need another photocopy. ... Anyone ( non-cop) opinion pls thanks

Actually Bear gave his best advice and we should all be grateful to be able to view the perspective of the law enforcement community. Your last post came off a bit rude. Your wife should have kept her licence up to date even though she did not receive the renewal notice. Yes, it's inconvenient, but driving without a licence for four months is overdoing it. With that being said, you need to check with your insurance company whether they consider this particular ticket a "major" or a "minor". If it's considered a "major" I'd take any plea deal that the Crown would have to offer. If it's considered a "minor", you have 3 options.. 1) Pay up and take the conviction 2) Take it to court and beg for a lower fine and easier payment terms (blame it on the economy  ) 3) Take it to court and go for broke.. Here's an excellent "cookbook" http://www.ticketcombat.com/ If neither of you is comfortable with going to court, you can always hire a reputable paralegal firm. Based on my previous experiences, I recommend Redline. They are a bit pricier than most, but they won't take a plea if it's not in your interest (which most paralegal firms would do).

What kind of a man would put a known criminal in charge of a major branch of government? Apart from, say, the average voter.
you asked if it was proper offence and I answered yes....nothing biased at all there! It is one of the few B&W offences in the HTA. and couple other things that might come to mind... 1) If police would let the person continue without a licence and then for some reason there is a collision....I certainly don't want to be on the end of a civil suit for knowingly letting an unlicensed driver continue to drive. 2) Everyone on the road needs valid licence plates and licence and all people pay for same, how would it be fair to those in compliance if police just let those that don't comply (knowingly or not) go down the road. Besides as many on this forum can attest, I do not chatise people on here. I try to bring a perspective from the other side which 99% of people do not know at all.

Absolutely. And as I said before, your input is very much appreciated, and you've been on this forum much longer than I have. Now for the charge... this one is very difficult to beat. Even a paralegal couldn't do much. I believe this is an absolute liability offence, meaning that the only thing that matters is whether or not you committed the act. Unless the ticket has a fatal error or the cop does not show up for trial, it's going to be almost impossible to beat. Given that, unless the ticket has a glaring error, you should try to talk to the Prosecutor before the trial and see if you can get a plea bargain out of it. You might be able to plead it down to something less, or possibly, as Firestart said, ask for a reduced fine in court if that fails. Hoping the officer doesn't show is not a worthwhile strategy anymore, as the Prosecutors are now scheduling trials based on the availability of the officers. Usually Prosecutors are receptive to plea bargains. Good luck with it.

I have just over 700 posts....I`m sure if I was an @$$ or overly biased I would have gotten the boot a long time ago, with a don't let the door hit you on the way out thing. I have seen other forums (BookM, Reflections know some) that go on personal attacks all the time, not only on police, but civilians as well. This site is very educational and fun and needs to stay this way.....now where did my mocha go

And I totally agree! Hwybear is an asset to this site, and will always be respected. And this site will always remain the way described by hwybear! I think we should actually thank hwybear for being part of our community! As his posts and opinion are always valuable. Also, to the original poster, you should use this advice, as you are getting unbiased advice for FREE! And don't get mad when ppl tell you these things, becuz driving for 4 months without a license is not the norm, and is not an accepted practice not only by the law, but by the citizens who share the same road with you too! In the end, we are just here to help you out.

Agreed! And I know of the site that you speak of... but if it's any consolation, the forum that pertains to my line of work is a lot worse. Or was until very recently. Anyway, this site is entertaining and informative, above all civilized, and it should stay that way. I know I've learned a lot from visiting here regularly.

Definitely. I also like that the site isn't too busy; I lurked for a while on the Blueline forums, but just couldn't keep up with the mountain of posts every day. They also have LEO-only forums, so it's harder to really get to know them. If I had known more cops like Bear and with his attitude, I probably would have joined the service right out of high school.

Back to the original point. Did you make one of your three options. Take it to court. Who knows maybe the officer will be unavailable, then it gets tossed. Its worth a try, because in the end you pay the same fine. When you go to court, if he shows up. Play stupid, and tell the JP, you thought it had to go to court to Plea, Guilty with an explanation. Then ask for forgiveness, lower my fine please.

Even though sometimes we all dont agree with hwybear.... I enjoy him on the site. I am always interested to hear the perspective of the officer. His posts are very informative. I have came to have alot more respect for Highway police and the OPP in general (except Fantino) from reading alot of hwybear's posts. Maybee if the rest of the public knew what we do people would respect highway police alot more. This site is educational, officers and drivers learn from the topics and the posts. I wouldn't call anyone an ass but it is perfectly fine to disagree without losing your cool or taking it to far. Half the reason i love this forum is because of him. I wouldn't frequent this site as much if it weren't for him. I do like to hear a HSD perspective and he provides us with ton's of info on laws, policies, equipment/ strategies police use, etc! Some of us may not like 172, lidar, or boston cream doughnuts, but that is no reason to hate police or think they are all the same. (well i don't like doughnuts so i hope hwybear doesnt hate me  )

I wonder how many times hwybear has slapped 172 on those tim hortons trucks that pass along the 401. Boy oh boy i bet the whole detachment couldn't wait to impound one of those  . I bet they would detain and impound the whole truck and everything inside the trailer to! Officer of the month! After all it is a stunt to drive a truck full of doughnuts under a lonely over pass at night with a tired and bored officer. Or all those late night " routine inspections he must do on those poor trucks" i bet everyone of them requires them to unhitch the lock on the back of the trailer:P. Hey sometimes those trucks dont have all their wheels on the ground to. Impound the trailer?

haha the stripes on that cat remind me of a marked OPP crown vic. Although i am not sure if i have love for them but do they ever get my attention. Last time i was on the 403 i saw the usual guy at the bottom of the hill between mavis and erin mills and i just pulled right over in the right lane and passed him at exactly 99 km/hr. Reflections, hwybear told me if you want some "bear love" to go under Elgin rd with a FuzzBuster 2000 when they get a Lidar trap set up.

I have a problem and not sure what the hell to do about it. Few days ago I was stopped on a street going westbound against blinding afternoon sun following the flow of traffic. I drive a taxi for living in Toronto and have ACZ driver's license. I have a perfect record both for professional as well regular demerit points. I haven't been pulled over as a matter of fact in some 15 years for…
I have recently gone to court for a speeding ticket issued by an OPP officer. As it stood, the officer forgot to sign the ticket. So at my trial, before I made a plea, I pointed this out to the justice of the peace and asked that the ticket be quashed. I was asked to produce my copy of the ticket, which I gave and the JOP then agreed with me and dismissed the case. Before he did so, the…
I got pulled over (along with about 10 other cars) for going through a road closed sign. I had just pulled out of a parking lot pretty much right beside the road closed sign, and with about 4 cars behind me there wasn't much I could do but go through, so I think I have a good chance of fighting it. However, on my ticket under the Signature of issuing Provincial Offences Officer, it's left…
So here's my situation, any advice would be appreciated.
On June 26, 2013 I received a ticket for 25 over in a 60 zone
In early October I received my notice of trial (Feb 25, 2014)
In early January I sent in my request for disclosure
In late January I received a letter to pick up my disclosure, however when I picked up my disclosure it wasn't typed (I had requested it to be) and I needed…
Is there a legal requirement to report an accident to the insurer?
Scenario
- 2 vehicle accident
- each vehicle has less than $1000 damage
- each vehicle has damage roughly equal to insurance deductible
- a police Accident Report was completed
In this scenario the drivers decided to repair their own damages. But are they legally bound to report the accident and damages to the insurer? ...and out of…
I will be representing my wife at her speeding trial next week. Mostly everything is pretty much run of the mill but since she wasn't speeding we will be having her take the stand. Since this opens up the opportunity for the prosecutor to cross examine, I am just wondering if anyone here knows what kind of questions we should expect from the prosecutor in order to best prepare.
i got pulled over by a cop this morning in my kids's school zone for failure to stop at a stop sign. i am thinking of fighting this ticket, but i noticed that on the ticket itself it only says "disobey stop sign - fail to stop" and there is no mention of the demerit points. a co-worker mentioned to me that a ticket should state how many demerit points i am being docked. i know the Highway Traffic…
Alright, so this happened back awhile ago on June and I haven't appeared in Court. However, I would like some inputs and advice before I get into this battle.
Back in June I got a Speeding Ticket claiming I was going 100km/h on Blackcreek going south towards Lawrence. The Speed Limit there is 70km/h.
At this point of time, it was roughly traffic hour around 4-5PM. Coming off of the Highway, and…
Ive already done searches, read the act as best i can but still haven't read a complete answer. Where in the HTA does it state that the front license plate must be attached to the front bumper? I have it on the passenger sun visor (if ppl remember the old temp permits that taped to the pass side of windshield) i figured that this spot would be the same. However now they have got rid of…
My son was returning from school and was just entering the driveway when another vehicle hit the rear end. Police writes a ticket "fail to yield from private drive" 139(i). He is going to fight this ticket and made an application for disclosure. The trial is next week and he still hasn't received the disclosure.
He checked with the court last month and they said that they will call when disclosure…
i was travelling on the 401 (posted speed 100km/h) in the far left lane, when i caught up to a vehicle going ~110km/h. I patiently waited for the vehicle to move over a lane, but they did not. The vehicle behind me moved to the center lane to pass, but because he was a safe distance behind me, i moved into the middle lane ahead of him to pass the slower moving car. When I accelerated, i…
So I was returning from my honeymoon in Montreal, and was cruising down the 401 just inside the Ontario/Quebec border. I was passing one of the Onroute stations and saw an OPP cruiser. I checked my speed and I was doing 120. A few kilometers up the road the cruiser pulled me over and told me I was clocked doing 132 by the aircraft. I was a little surprised to see the ticket was for the full…
I made a right turn during prohibited hours (7am-6pm) in Toronto. I was ticketed by a COP who was specially watching for that trap.
After I've received the ticket HTA144(9), I discovered one of the seven digits of my license plate was incorrectly written on my ticket. I was thinking about to make a First Attendance at the court office to see the prosecutor for a reduced charge...any advice or…
Have been busy and haven't had much time to follow up on this...
Went to court having not received disclosure (and was not organized enough to apply for a stay), so the trial was adjourned. They photocopied the officer's ticket and notes and provided a log sheet from the plane. I've sent another request for the rest of the disclosure items.
So here's my question -- can an officer amend the ticket…
I am not sure if my case is really a case of " mis-use parking permit" and need some advises on whether i should fight the ticket. Here is what happened:
During the labor day long weekend, I took my parents to diner at a local shopping mall. (my father's hip was broken in 2016 and he's been on wheelchair since, the permit is in his name and I been using the permit to help him for doctor's…
I have a court date coming up where I need to subpoena one of the officers that was present when I got my ticket. The issuing officer didn't include the fact that the second one was present at the time in his report (disclosure) but did give me the second officers name and badge number after the judge told him to do it.
What I'm looking for help with is the process of me getting to…
I got pulled over on a 4 lane section fo Highway 7... Thank god I didn't get a stay at home ticket as well or my car impounded.
Officer clocked me at 156 km/h he decided not to impound my car and give me a 149 km/h since it was my first offence and he said I was polite and respectful. I would give this officer a 5/5 review if I could, very polite and respectful.
Long story short, I was driving from Toronto to Ottawa and around Napanee with my friend in two separated cars, the officer was parked on uturn. He followed us turn his light on and got between us and pulled us over, he told me that i was running at 152 km/h without showing me his LISAR. they suspended my and my friends license and impounded the two cars for 7 days. This was a Friday in January…
I'm unsure on what to do here. I was under the impression that I could request a stay on the day of trial because disclosure was not given to me in an adequate time. I requested disclosure 2x by fax, 5 months ago.
I read on ticketcombat that I had to file a motion 15 days prior to the trial to request a stay of proceedings.
Does anyone else get blinded by fog lights on rural roads? I don't seem to have a problem with them on lighted streets, but the badly aimed fog lights or ones with a poor cutoff really get to me when driving the Escort. I just came back from a 20-minute drive, and every single pickup truck had fog lights on, and forced me to focus on the bottom right of the road. My windshield is clean and…
