How to ask the Judge to withdraw the charge at the begining

My question tonight as I go over my material and get my questions ready for Trial is.... If I feel this charge is incorrect how can I go about suggesting to the judge before the trial begins the the charge should be withdrawn without annoying him. Or is this even possible...
