Re: Won at trial for Failure to Stop at Stop Sign. Thanks!

I always have thought you should stop inline with the stop -sign if no white line.
If a white line you stop there then proceed with caution.
My guess is is you did roll the sign.

If I understood the above correctly, you don't need to go through the tedious paperwork of filing an 11b before requesting a stay of proceedings?

What paperwork is needed?

That isn't clear.

Re: Checking a Licence plate

Both the cops and the parking ticket people drive around in cars with the ability to read a tag.

They have 4 flash bulb's and ? camera's.

If you meet one the flash is pointed down but you will think "what was that, the first time"

Re: DUI charge on Private Property but NOT caught in the car

Considering how the OP is just an "acquaintance" and was probably not there, it doesn't appear we have enough details to be of any help. As I posted earlier, the charged person should be seeking legal counsel right away.

You are correct.
I was in court when a defendant told the court that the spark plug wires had been removed.

As long as someone can place her behind the wheel is all that's needed and the do not have to catch her in the car.

It does not matter that it was on private property.

(wow) that 78.1.2

It is pretty broad.

My company called the DOT to get clarification and they answered.

As long as it only takes 1 finger to operate it is ok.(like a radio dial/button)

You said you looked . So the lights could not have been on.
I have seen cops do that a lot (no lights race forward)
If the cop was not in an emergency situation the cop was careless.

Explore how to charge them.(the cop was in the wrong if no light's flashing)

Might want to get disclosier first .

DWI was not criminal then either.

Re: 168 in 100 zone. 400

I still find it unusual that speeding exists on top of stunt driving. .

can put it another way, as an example

a person can be charged with "impaired driving" and can also be charged with "driving with over 80mgs of alcohol in 100ml of blood" (which has a numerical value) as BOTH are seperate offences
now relate that to the HTA
a person can be ...

Surprising though, given all the technological wonders we have in this day and age, that a driver cannot use technology to prove his/her innocence. As for those cams you were talking about, I am fully aware of those, and contrary to your belief some models DO include the date & speed (I.E: the DOD F500HD).

Re: ATV With Tracks - Status and Case Law

Is there any hope of Ontario updating either the HTA or ORV to permit ATVs with tracks on roads?

Having tracks puts the ATV in a no-man's land as far as legislation is concerned. It's not an ATV because it doesn't have wheels - even though you straddle it to ride.

If the law says a track excludes the machine from being classed as an ATV, could ...

Re: Improper left turn with Failing to provide Motor owner T

If you want to get one of the charges dropped, you'll have to work out a plea deal with the Crown. Quite likely they would be willing to drop the ownership charge if you plead to the improper turn. You can either request a pre trial resolution meeting or try to work something out the day of the trial.

Thanks for your advice! By Pre-Trial ...

Each time it was at night.

I hate driving close to the car ahead.
It never gets anyone there quicker then a minute or 2.

It happened again last night.
I was in slow lane a bit over posted speed.(but about 7 car lengths back)100 k zone.

When I took drivers education the rule was 1 car length per 10 mph(16 kph)

How can you plan a defense not knowing what they have?

I think if you attend court and say not guilty that it will be dropped.

Or more likely dropped before you can say any-thing.
