Re: Open Alcohol In Car

hwybear wrote:other than a fail to surrender charge, open liquor is very easy offence to prove in court. Located a open 341ml bottle of Coors Light. I observed 1cm depth of beer in bottle.

No demerit points for a LLA offence.
Do you have to provide the open liquor(evidence?)

I never tried but to me it seems easy to beat.

Re: Parking Lot Incident

Was the restaurant in the hills?

If you hit a parked vehicle it is your fault.
His collision coverage will pay for his damage /no-fault/

My guess is he just straightened out whatever was bent no worries.

Re: Open Alcohol In Car

Hey Guys I was hoping you can help me out here. I was charged with having open alcohol in my car. The only problem is that I wasn't even drinking or anything like that. I had empty bottles on the passenger side floor and I had my cousin sitting on the seat, and one bottle had a little bit left in it, maybe 1/4 inside. The cop still gave me a ...

Re: Improper Passing or Careless Driving?

Tomorrow is the date, to set a date. I'm sitting in front of the forms for XCopper, who promise me for $678 to get it reduced to 3 Demerits, though I think I can talk to the Crown Attorney and probably get that done on my own. XCopper does what many places do, they say that they prioritize: Waived/0 Demerits/2 Demerits/3 Demerits/Trial, which ...

Re: improper right turn

Ok I will try again, I did not reach the esso. Just as you past the foresters building you turn right onto eglington now going east. On the east bound eglington after you past don mills there is a right turn lane which heads back into the foresters building area with all those new townhouses. I did not turn into that lane as I know it will just ...

Re: Speeding and Insurance - looking for opinions on my tactics:

Every city In Ontario I have entered has a basic street rule sign on the edge. Usually no parking 2AM-7AM and 50 kph unless stated other-wise.

Speeding is absolute liable but if there is a hidden sign I think you could beat the ticket.

I see lots of stop signs covered with foliage maybe some-one who got a ticket like that needs to sue the city ...

Re: improper right turn

I was charged with an improper right turn, this happened at 10am on a sat. The first lane to turn into is a lane for people will be who are turning into a complex. Next lane over is the bus lane, I went straight to the bus lane. The officer says I should have first gone into the closest lane which would be for people getting ready to exit off ...

Re: Received first time careless driving ticket...what to do?

What has to be viewed here is your conduct. Was it reasonable? Would a reasonable and prudent person done the same?

Absolutely...I saw a whole group of cars swerve off the road yesterday, go over a sidewalk, across a lawn to miss a squirrel

Now, to be a little more serious, I have spoken to insurance about this and if it is a "swerve to ...

Re: improper right turn

I was in the right hand lane turning right on to eglington heading east. There is four lanes going east, I went into the bus lane knowing the first lane was a right turn exit lane. Ticket infractrion was a improper right turn, highway traffic act section 141(2). Also the form sent to me telling me when my court date is has my last name spelled ...

I've never heard of this, where is this written?
Alberta school bus rules at that link. Ontario wants $20.00 for same.

I don't have ontario rules but other provinces have reduced speeds for school buses.

Re: question for insiders re prosecutors and their witnesses

It is not a good idea.

Like OPS said the DA will get a adjournment and you will get no deals.

So you agree with OPS, but can you elaborate on why getting an adjournment is necessarily bad? As I pointed out, a reschedule could be used towards an 11b argument, no? And once again, I ask, will the DA always get an adjournment?

Also if you live in ...

Re: School Bus lets my kids out at a 4 way stop sign

Costs about $20.00 for handbook.

But it seems all cars must stop while the lights are on unless divided HWY.

I haven't read it either but it has to use some common sense?

As to the speed I have seen it written on the buses.

Re: HTA 136 (1)(a)Failure to Stop at Stop Sign, Arguement valid?

After the DA is done asking questions you get a turn.

eg
At what time did the officer check to make sure the sign was there?
Did they check to see if it was still there at the time of the ticket?
Sounds like they can prove the pole was there.(no offense)

hwybear lead you to the answer.
DA gets to rebut it.

Is it in your discloser?(if not not ...

Re: question for insiders re prosecutors and their witnesses

I thought something like that might happen, but is it always the case? Perhaps the JP might think it would be a waste of valuable time/resources to reschedule. And then there's always the argument for the right to a speedy trial if the reschedule is months away. If everyone played hardball and got a reschedule, surely that would be a very ...
