Re: Snowplows

Short answer: Yes.

Long answer, here's section 157 of the Highway Traffic Act which outlines backing on a highway:

Backing prohibited, speed limit over 80 k.p.h.

157. (1) No driver of a vehicle shall back the vehicle upon the roadway or shoulder of any highway divided by a median strip on which the speed limit is in excess of 80 kilometres per ...

Re: Remember those annoying Sylvania light bulbs commercials?

The "negative afterimage" left by those superbulbs is bad enough that on one occasion I actually pulled off the road for a few moments... couldn't see enough to drive safely.

I'm not a big fan of introducing more regulations... but I think it's reasonable to say that your regular bulbs must be between "x" and "y" candlepower, and high ...

The fact that someone thinks that text-messaging while driving on a 400-Series Highway is a good thing to be doing... well it's becoming more common these days. I've seen people do it. Maybe in driver's ed classes we need to start showing photographs of people who've been in car crashes (or what's left of them) instead of the cars ...

I wonder if the manufacturer has guaranteed its accuracy through the service life of the radar unit, if the units have a written "service life."

Funny that the unit has its own self-contained accuracy test. I'm sure it has an internal integrity check (internal circuits & processor check), I have no idea about accuracy. Radars I've used have a ...

I don't think the article has enough info. Following too closely, definitely. Careless driving... maybe, article didn't say if their lights were activated or not, if they were careless might be appropriate.

Then again... transport truck in ditch, police cruiser ahead (lights or not), if the driver was paying attention he should've noticed the ...

An idle question...

So while I'm up burning the midnight oil baking goodies for Christmas breakfast tomorrow... I thought I'd ask this question out of curiosity. We had very high gas prices this summer, and now the economy has gone for a skate. Gas prices will go back up eventually, I'm sure, but for now they're low. Did you adjust your driving because of the high gas ...

Based on your description, this ticket sounds like it will easily be beaten. I'm not an expert, (DynamicLegal is), but I think that you have a good case that you were really obeying section 132 of the HTA. Other vehicles were able to pass you safely, you weren't being a left lane hog (couldn't really have been on a road with one lane each way ...

Couple of questions... will help us help you here with some more info...

First, what road were you on? How fast was traffic around you going? What were the road conditions like? Finally, if you were on a multi-lane road, which lane were you in when the cop tagged you? All of that is important. There's no specific statement of "too slow" in the ...

People rely way too much on someone else to do something, then to blame them for their own inaction of driving according to weather.

If the entire bill for the crash is going to be shipped to a driver, as opposed to the way it's done now, I don't think partially faulting the city for failing to adequately clear the roads is unreasonable. As for ...

In other words, the stop sign prior to getting onto a public roadway is enforceable, but the ones in the middle of the parking lot are not. Correct?
More or less, except for the Insurance Act, which still applies in parking lots. So, bylaws notwithstanding, if you don't hit something, there's not much that can be done.

Watching parking wars on TV. One guy gets a ticket every day...to park legally it was $26 bucks for a day, but a parking ticket (if tagged) was only $21
Savings of $5 per day by breaking the law. :?

I get the feeling that the people responsible for the ticket being less than the pay parking won't figure it out even with the TV publicity.

I could be convinced that slapping someone with a fine and demerit points if they don't adjust to the road conditions is a good idea (in fact, it is), but making the driver pay for everything that insurance is supposed to cover?! Come on.

TC just about covered everything. Speed limit is, in theory, the maximum speed that you may travel at under ideal conditions. You know that's not how it's set, but that's what the "eyes of the law" more or less view it as. The only thing that is materially relevant to your defence is that you were driving at a speed that you felt was reasonable and ...

Your suggestion, Bookm, isn't actually that "way-out." It would give the kids chances to practice with a variety of situations so they'd be better prepped when on the road. Expensive? Yeah, but I'd submit that the cost of collisions to the economy is much larger, not to mention the human toll.

Moreover, I've come from the exact environment that ...

If the longer graduated licensing was accompanied by mandatory real driver training which teaches new drivers things like proper road safety, REAL safe driving habits, skid control, evasive manoeuvres, lane discipline, basic vehicle maintenance, how to properly change lanes, etc., then I'd support it.

This is nothing of the sort. It is just ...

I've done the switching process before (went from Ontario to Michigan, then back to Ontario). As long as your ticket is paid or you've been found not guilty/charge dropped/whatever, you're all set. Yes, the speeding ticket will ...

Also bring in about 40 friends who are to testify on your behalf as "expert witnesses." Point them out to the Prosecutor when trying to plea-bargain, along with your mountain of evidence.
