Yes, you always want to challenge the evidence of the officer if you go to trial.

What TC is saying is that there is a POSSIBILITY that the prosecutor MIGHT, if he is vindictive/spiteful/whatever, withdraw the charge and put it back up to 146 km/h. That is not that common, though. Sometimes they will, but more than often they will not.

Make sure that you send your request for disclosure via registered mail or courier, that way they can't claim that you didn't make the request. Did they offer a First Attendance meeting or did it just go right to trial?

To get a good idea of how to fight the ticket yourself, go to www.ticketcombat.com. This is a website created by another regular poster. Lots of good info there.

Some bike paths in Toronto have speed limits, such as the path through Wilket Creek Park, which is 20 km/h. A sign is posted. As for sidewalks, I don't know.

The by-law permitting smaller bikes on the sidewalk is to allow children to ride bikes without having to mix it up with Toronto's notoriously inattentive, aggressive, pig-headed motorists ...

I once actually saw a radio-controlled model airplane being flown on airport property zoom up and nail the wing of a sailplane coming in to land. Extensive damage to sailplane, model airplane totalled, no injuries, angry pilot. This means that probably that car driver's insurance company did their own investigation and found that he is guilty in spite of the absence of any police charges. So he probably was told that he will must pay his deductable!

What mechanisms we as a citizens have to fight improper police decisions other then the filing an official complain to police?

I had purchased insurance with the car rental which should make proving that I had insurance pretty easy. I believe I was more concerned with whether the JoP would be more interested in whether or not I actually handed him the piece of paper to prove that I was insured.

If the officer was looking for a "lower speed sign" on the ramp, meaning one with black lettering on a yellow background, that is NOT enforceable as a speed limit, it is an advisory speed only. If he ticketed you for exceeding that speed, the charge would be thrown out. Street racing charges?! Good God!! Another reason to get this law struck down ...

Just a couple of thoughts, as far as speed tolerance. Here in Toronto, up until very recently, OPP wouldn't stop you unless you were going over 130, sometimes considerably faster. The ones who patrol the 416 start pulling drivers over at 125 km/h.

Toronto Police, unless it was Traffic Services, usually gave drivers 25-30 over. Traffic Services ...

Hopefully soon the street racing law will be found insonsistent with s 11(d) of the Charter (not s. 7). Until it is struck down, it is still in effect.

That sums it up nicely. The impoundment and other actions may be unconstitutional, but the the courts will decide that, and decide if Ontario must pay restitution ...

Something about the insurance company's response does not add up. Insurance companies are supposed to assess fault and payouts based on the Insurance Act of Ontario, not the Highway Traffic Act.
