Yes, you always want to challenge the evidence of the officer if you go to trial.
What TC is saying is that there is a POSSIBILITY that the prosecutor MIGHT, if he is vindictive/spiteful/whatever, withdraw the charge and put it back up to 146 km/h. That is not that common, though. Sometimes they will, but more than often they will not.

Make sure that you send your request for disclosure via registered mail or courier, that way they can't claim that you didn't make the request. Did they offer a First Attendance meeting or did it just go right to trial?

I had purchased insurance with the car rental which should make proving that I had insurance pretty easy. I believe I was more concerned with whether the JoP would be more interested in whether or not I actually handed him the piece of paper to prove that I was insured.

If the officer was looking for a "lower speed sign" on the ramp, meaning one with black lettering on a yellow background, that is NOT enforceable as a speed limit, it is an advisory speed only. If he ticketed you for exceeding that speed, the charge would be thrown out. Street racing charges?! Good God!! Another reason to get this law struck down ...

Just a couple of thoughts, as far as speed tolerance. Here in Toronto, up until very recently, OPP wouldn't stop you unless you were going over 130, sometimes considerably faster. The ones who patrol the 416 start pulling drivers over at 125 km/h.

Something about the insurance company's response does not add up. Insurance companies are supposed to assess fault and payouts based on the Insurance Act of Ontario, not the Highway Traffic Act. The fact that the driver says that his insurance company is using a "fail to remain" charge as the basis for determining that your son (or you) has to pay ...
