Perhaps some bias, although having looked at the full length tape, the actual time where the officer was in a position where Moats should have reasonably known that he wanted him to stop was a period of about 30 seconds, and that was when they were already on the hospital grounds. No demerit points. As far as insurance goes, most of them would just ignore this particular offence and not charge you any increase, unless you have a history of racking up numerous other tickets. That said, there are a handful of companies who would likely give you a small increase, but not anything too daunting.

Would think that said driver would be charged with Drive Without a Licence. The language seems to imply that if the conditions are not met, the licence is not valid.

The Justice at trial can amend the date on the Provincial Offences Notice. So yes, the invalid date can be corrected, provided that the officer filed the appropriate paperwork. The 70% stat came from a YD instructor... that was a while ago. I looked and I could not find any study to support it, but it would seem to make sense. In the mean time... the "left" lane next to the HOV lanes has been shown to be extremely dangerous:

Especially on a divided highway, some of them view it as the safest lane. They only have to worry about traffic to the right of them, and they don't have to dodge merging traffic.


Yep, only thinking about themselves. However... on any road, including divided highways, your greatest risk of being involved in a collision is travelling in the left ...

I believe, as a G2 driver, three demerit points will get you a very nasty letter from MTO. Try to avoid that one. But first, send in the paperwork to fight the charge. It is amazing how many drivers have little to no eye lead up the road, if you are scanning for dangers (collisions, deer etc....) you would see the big cruiser parked x-ways.


It seems that anyone who is travelling over 120 km/h and cannot spot a plainly marked cruiser parked in the median is not paying enough attention to be driving at a high ...

As much as I admit to having a streak of schadenfreude after hearing the OPP officer got the car impounded, for the court proceeding I think that she should get the same treatment as anyone else who was caught going 165 under this stupid law. The reason being that she is likely facing a Disciplinary Hearing in addition to the HTA charges.

I take it that the officer did not witness the collision, then. Without the witness, the case becomes more difficult for them to prosecute. That said, they should issue a subpoena for the witness. Yep, you don't need a front plate to get nailed by lidar. Michigan, for example, does not require front plates on the car, and police across the state heavily use lidar. These days most Prosecutors are checking with the officers for their availability when they schedule or re-schedule a court date. It might work, but odds are it won't change much. As for the other witness... who knows? Could work in that the officer might show but not the other witness.
