Perhaps some bias, although having looked at the full length tape, the actual time where the officer was in a position where Moats should have reasonably known that he wanted him to stop was a period of about 30 seconds, and that was when they were already on the hospital grounds. Here's the full length:

This story shows how a police officer should NOT handle a traffic stop such as this one. I mean, you have got to be kidding me, right? Be sure to play the video...

Some-one gets on the entry lane and speeds up to 60 kph and merges.
Now I am amidst 50 cars that have to avoid hitting this a--hole.
In an ideal world, that driver would have been pulled over and charged with an unsafe merge and impeding traffic. But then you mentioned that everyone was doing 120 km/h... so he could have been charged with ...

Re: Unnecessary Noise: D-Points & Insurance hike?
No demerit points. As far as insurance goes, most of them would just ignore this particular offence and not charge you any increase, unless you have a history of racking up numerous other tickets. That said, there are a handful of companies who would likely give you a small increase, but not anything too daunting.

Re: HTA 144(18) changed to HTA 130, is that allowed?
Yes, it is allowed, but changing the trial date and amending the charge to something more substantial is somewhat abnormal. Have you spoken with your paralegal regarding this yet? While careless driving is one of the most serious charges that can be issued under the Highway Traffic Act, it is also one of the hardest to prove. Your paralegal should ...

Would think that said driver would be charged with Drive Without a Licence. The language seems to imply that if the conditions are not met, the licence is not valid.

Re: 2 tickets i'd need some advice i think one is invalid
The Justice at trial can amend the date on the Provincial Offences Notice. So yes, the invalid date can be corrected, provided that the officer filed the appropriate paperwork. They'll have to amend it at trial. The officer can't just write over the old date on the ticket, as that would be a fatal error. It is a little embarrassing for the ...

Speed versus safety of cyclists
In a previous thread, racer asked if there were any stats on the survival rate of cyclists in collisions with cars. Here it is:
http://www.transport.govt.nz/assets/NewPDFs/Cyclist-Crash-Factsheet-July-07.pdf
A cyclist hit at 32 km/h has a 95% chance of surviving; at 48 km/h, 55%, and at 70 km/h, almost zero. This means the speed of the car at the ...

The 70% stat came from a YD instructor... that was a while ago. I looked and I could not find any study to support it, but it would seem to make sense. In the mean time... the "left" lane next to the HOV lanes has been shown to be extremely dangerous:

Especially on a divided highway, some of them view it as the safest lane. They only have to worry about traffic to the right of them, and they don't have to dodge merging traffic.

Re: 2 tickets i'd need some advice i think one is invalid
I believe, as a G2 driver, three demerit points will get you a very nasty letter from MTO. Try to avoid that one. But first, send in the paperwork to fight the charge. Pinch is right; get the information first and then decide if you want to fight it fully or call the Prosecutor and work a deal out. You may want to consult with a paralegal regarding ...

It is amazing how many drivers have little to no eye lead up the road, if you are scanning for dangers (collisions, deer etc....) you would see the big cruiser parked x-ways.
It seems that anyone who is travelling over 120 km/h and cannot spot a plainly marked cruiser parked in the median is not paying enough attention to be driving at a high ...

Re: O.P.P criuser impounded under 172
It seems as though most European countries engineer their road, traffic and safety systems to try to keep the traffic moving. Blocking the passing lane is the antithesis of keeping traffic moving. Here in North America, traffic systems and driver education is focused on trying to make traffic stop as often as possible and, when it does move, to try ...

Probably. Here's how to change the trial date:

As much as I admit to having a streak of schadenfreude after hearing the OPP officer got the car impounded, for the court proceeding I think that she should get the same treatment as anyone else who was caught going 165 under this stupid law. The reason being that she is likely facing a Disciplinary Hearing in addition to the HTA charges.

Re: Pushing up the court date?
I take it that the officer did not witness the collision, then. Without the witness, the case becomes more difficult for them to prosecute. That said, they should issue a subpoena for the witness. I guess it also depends on how enthusiastic/time-free the witness is. Suffice to say, if you think that the witness would be detail-oriented, collected ...

Drive in Ontario with a radar detector in the vehicle and you will get it seized. Doesn't matter if you're from a place that permits it or not. Same thing if driving through Virginia, which also prohibits possession of radar detectors. Only a handful of officers province-wide would even think of stopping a motorcycle for that kind of offence. Conversely, I would think that they might've been referring to this... although I'd rather see a Dangerous Driving charge issued.

Yep, you don't need a front plate to get nailed by lidar. Michigan, for example, does not require front plates on the car, and police across the state heavily use lidar. When I lived in the Detroit area, police officers would position themselves in semi-concealed positions with lidar and by the time the driver realized they were being tracked ...

If the officer says "you were going 50 over the limit, I am towing your car for a week," there is no requirement for the officer to show any proof to you at the time. You can ask them to show you, but they don't have to. In the rare instances where they do actually take the hand-held unit and show the speed they registered, they are doing it only ...

These days most Prosecutors are checking with the officers for their availability when they schedule or re-schedule a court date. It might work, but odds are it won't change much. As for the other witness... who knows? Could work in that the officer might show but not the other witness.
