To my understanding of Dangerous Driving, speed alone is not enough, there has to be other factors involved, but I could be wrong


The R. v. MK decision said basically that excessive speed alone could be called dangerous driving.

The wrong time probably won't get it thrown out right away, but it will really weaken the Crown's case because it damages the officer's credibility. The Prosecutor may just drop the charge rather than risk losing in court, depending on the Prosecutor.

Our local police forces such as Guelph police or Toronto Police service allowed to patrol 400 series highways???

If they want to, yes. Toronto usually just uses the 400-Series to get from point A to point B, but unless they're Traffic Services, they don't pull people over unless the person is really driving like a sociopath. York Regional Police ...

One more variable to add. Let's say a cargo van weighing, oh, say, 6000 pounds is travelling 60 km/h. What would his stopping distance be compared to a Civic/Corolla/Cavalier that weighs half as much, but is going 80 km/h?

They do not realize on a daily basis "police are looking for speeders" where majority of drivers don't look for the police, by the time they realize it that is a police car, they have already been clocked, then brake.....then look at their speedometer.....and it is always...."when I saw the officer".

I should add that going 85 MPH or faster in Virginia, which is roughly 135 km/h, is usually a jail sentence. Usually they send you to the county jail for a week. Go too fast and the officer won't bother with a ticket, he'll just slap the cuffs on you and impound the car until you've made bail. They are very strict about traffic laws there ...

Insuranse company doesn't care about convictions like that?

Fail to sign ownership in ink, no. There are one or two very weird insurance companies that would but the overwhelming majority don't care. That particular offence seldom, if ever, will have any effect on your rates.

In short: 19 + G2 + traffic ticket = OMG MY INSURANCE IS INSANE!! There are only a couple of insurance companies that tend to be sympathetic to younger/inexperienced drivers who get tickets, but the overwhelming majority of them will drive your rates through the stratosphere, particularly for an offence such as following too closely.

Medical stuff is always touchy. As racer and ticketcombat said, this is an MTO issue, not a court one. You may also want to try to find a doctor who deals with driver licensing, some of them have a specialized practice. I don't think having DT due to drinking is a disqualifying condition; seizure is disqualifying.

I sat near a guy at the 1st attendance meeting at 1530 markham rd. he was charged for the same thing, he bought the sticker but had not put on the plate, the prosecutor or assisant prosecutor or whatever he was, signed off the ticket and told the guy the charge was dropped

They should withdraw the "following too closely" charge and replace it with improper brake or unsafe vehicle, not add the other charges. Pointts (or any other paralegal) may be expensive, but considering that you're a young driver with a G2, and have been charged with following too closely where a collision occurred, it would be well worth it. Just to add to what Bear & Reflections said... the US is big on "jurisdiction." People get out of tickets down there because Officer So-and-So "didn't have jurisdiction."
