Insurance charge is reverse onus. Meaning they have to prove they had insurance.

The reason something needs to be certified is people will print out all kinds of letters on their home computer and bring it in. (I have seen this happen).

Being it is a 5k fine you want to make sure you have what the courts will accept. If not you could walk out ...

Being found not guilty will not change the police report. I have had many people come up after and want the report changed after the court outcome. I have always said no and stood by the findings.

You can contact the police and get a copy of the report.

Yes. You were convicted in Quebec and that is on your Dl so it goes to your Ontario DL when you transfer over. Doesn't matter that they are for an offense that has no points in Ontario.

police in Ontario can stop any vehicle on the road to check DL, Insurance, and registration.No offense is needed. Checking for a plate is checking for registration. Maybe the vehicle had no plates at all.

Since they can stop any vehicle to check for those it is not a arbitrary detention. This was fought and decided years ago.

Sidewalk is part of the roadway. Simplified is front property line to front property line is the roadway. So side walks and ditches and even encroachment a are part of the roadway.

So if you we're driving a car down the sidewalk then your just acting like a pedestrian....

The fact is you are NOT a pedestrian and where charged appropriately.

Because I believe in the system and believe there should be consequences to actions. When courts say you must show up for court and don't a warrant is a consequence. And I won't lose any sleep over someone missing a vacation because they did not want to go to court.

I sure hope that your are never the "victim" of a collision and the witness does not want to appear in court. Even better if it is a he said/she said where the witness is the only one who can get the blame off of you.

Because then you will see just whats it like to get screwed.

We had a JP here issue witness warrants for all the missing witnesses ...

No for speeding no they do not have to identify the vehicle. Many times in court it was I observed a silver car speeding and stopped it. The driver is the one speeding. The car is not committing the offense.

Vehicle offense would be something like a head light out or missing plates

Moving offense would be operator induced for lack of a better term.

Speeding would be a moving offense. Unless some how the gas pedal is depressed by the vehicle itself.

Get the transcripts from court. I have never seen a prosecutor give you nintey days to think about an offer. Most likely it was nintey days to pay and you misunderstood.

The problem I see with your grade argument is the 203 meters is displayed by the Lidar and not estimated by the cop. So I would suggest that the officer was standing at least 203+ meters away.

Losing sight momentarily is perfectly acceptable to the courts.

From the notes the Lidar was tested at 1500hrs. A time does not have to be written in for ...

If the decision went the other way how do you think drivers would react to having the device seized and sent away to determine if it is capable of sending or receiving and then held as evidence for later trial.

Yeah when tickets are not paid in some provinces they issue warrants for arrest. . In Ontario they suspend your DL instead.

I do not know about Alberta but as an example I have seen Sask residents with warrants for Dogs at large..Etc.

And no you will not be arrested in Ontario and sent back to Alberta if there is a traffic warrant for you. ( can ...

And if you do not pay the ticket thanks to the agreement you DL can be suspended in Ontario if you do not pay depending on Alberta's policies on unpaid tickets.(I do not know if they go to warrant or suspend Dl's)

It does not have to be a glitch or anything. Sometimes cpic is down and we cannot run people, we still give out tickets when this happens. Sometimes we run people and actually miss the hit, or if your running over the radio the person doing it misses it . Or Sometimes we actually do not run people as there could be a bigger call taking up the radio ...

First you were not found innocent. There was a problem with the case and they declined to prosecute. If you really want to get into innocence how do you explain the breathalyzer readings that show you were drunk wile driving.

Note Yes we do field sobriety tests in Ontario. I should know as I am qualified to give them.


Usually they are done when you suspect drug induced driving but they can also be used for alcohol intox.

Province of Ontario no probable cause is needed. You can stop a car to simply check the for drivers license, insurance, and registration.
