Re: Copy of officers notes versus original. Custody of notes

1st how do you know they were copies? We use electronic notes and they print out on copy paper.

2. I actually use copies as I we tend to file notebooks wit our property room. The only thing in criminal court is that they are the same as the ones that were disclosed and there are no additions or deletions.

In fact we now scan our notes to the ...

If it is a hand written ticket it needs to be signed. If it is an electronic printed ticket it does not need to be signed.

Re: Accessible Parking Permit Seized

I hear this story all the time. My "fill in the blank" is just in the store/business etc.

I wait 5 mins and lay the charge and let the courts sort it out. I also seize the pass.

You may not want to say where he was but you would rather take tie inconvenience of going to court? That makes no sense. If he was there you won't get a ticket.

Re: Stopped for truck inspection, charter challenge 10 (b)?

There is detention and there is arrest in Canada. Detention does not automatically trigger the RTC and such where as arrest does. Basically when the Officer tells you that you are under arrest that is when RTC kicks in. Sometimes based on evidence a charge will get tossed when the courts believe that someone was actually arrested and not detained ...

You were not arrested. . RTC only comes into effect when You are arrested.

The HTA allows commercial vehicle inspections as part of their licensing conditions So you were not detained either

Re: Calibration & testing requirements for radar & blood alc

There are stringent calibration checks and accuracy checks that are required for Alcotests and Breathalyzers. Cases get thrown out when they are not done.

How ever unlike radars they are not tested daily but are tested every week, 2 weeks, etc depending on the program approval and instrument used.

Re: Requirement for police to identify themselves when asked

Unless they are out of uniform there is no requirement. Seems that this is some internet myth that police have to identify themselves with three pieces of ID or that they have to present a business card when asked. Usually it is something that Sovereign citizens have concocted.

There is no such a requirement. In fact I do not even carry business ...

Re: If a cop claims that your speed was 84 km/hr in 60 zone

If the disclosure is really only what you received, it's a slam dunk. That being said, those are some of the absolute worst questions.

Why is the colour of your shirt or whether or not you were wearing khakis relevant? It's a speeding ticket. The officer is not required to remember what was on your dash, what color your seats were, or what was ...

Re: Warning for careless, How long on record for?

Yep the in house record would show you were charged regardless of the outcome in court.

The two are not connected. The in house record just details what was happening at the time of the stop and that is you were warned or charged. It never says your guilty as that is for you or the courts to decide.

As for the SSR that I bet is from the MTO ...

Re: Electronically printed Certificate of Offence

Because that is the way the system prints it out. I didn't make or write the software that writes the ticket, neither did the jurisdictions. We bought it and that is how it prints.

I would suspect printing a not used certificate is cheaper than creating custom software and hardware system.

up to 12 beer a day IS a drinking problem. You say you do not drive but how is the doctor to know you are telling the truth? Most drunk drivers I have arrested only had "one" drink hours previous.

In this case the doctor did the correct thing.

I you have to ask about this kind of question "why not just return them and get true amber ones?" Then you will not havee to wonder about this. Plus if you think they are red and a problem you are not the only one thinking the same thing.

This information is not normally available to other services.
