So you turned across the path of an oncoming vehicle and somehow you think the accident was 50-50?

What happens in court does not effect fault of the collision.

Yes the other party can sue. That is independent of this collision.

Unrelated but sort of related. Your right you cannot be convicted of impaired driving and over 80 but you can be charged with both and court even fought on both. If found guilty the judge will decide which one your guilty of.

We'll take a 30 minute drive to Lindsay and you can explain to your supervisor how you tried to pull over a pedestrian for a traffic stop". I mean... what if I had locked my keys in the car? Actually is is a summons and gives an automatic court date. The 15 days does not apply. It IS automatically going to court unless the person pleads guilty on the first court date. Plus the officer will not be there on the first court date.

once the notes are entered and sent from the cruiser there is no way to modify them by the officer. All we can do is read and print them.

It is a criminal prohibition that is handed down by the courts. Ontario Gov't has noting to do with it other than following the courts direction.

Life suspension means life suspension. You lost your right to drive and I for one am glad.

your making a whole lot assumptions about the cop. How do you know he was not sick?

I know here we when we have court we have to call court and leave a message when we are sick. Plus we usually message other cops going to court to tell the prosecutor.


Oh and more than likely the information as to whether the cops was sick is most likely covered ...

By law insurance companies send registered letters to the owner of the car advising them of the cut off. If it was your car you would have gotten that letter.


The fact that you lost your car will carry no weight as to the penalty. Here it is minimum 5k if you actually fight it in ...

I never said impound. Towed for being an abandoned vehicle on the roadway.

I call the tow company and tell them this vehicle needs to be privately towed. You are responsible and can have it towed anywhere you want as along as it is off the road.

We do it all the time.

Love it. Cop does not tow the vehicle, which they could have done at your expense. Cop give you a ride home which he did not have to do and yet your complaining.

So you save possibly hundreds of dollars and you are complaining.

And people wonder why cops have stopped cutting the public slack or become black and white when it comes to enforcement ...

Criminal is federal and to get a criminal suspension you need to be convicted in criminal court of over 80 or impaired driving etc.

. The Over 80 ADSL is a provincial suspension that is given for just blowing over 80 and getting charged.

Plus we also lay criminal fraud charges. It is about the ugliest CAIA/HTA driving charge there is.

I have yet to see ant crowns reduce or plea the charge away and fines given in court are always the maximum.

No it does not..it falls under the criminal charges and only in cases where a police officer induces or rewards a person into doing something that they would not normally do.

Yes they can. happened today with a red light ticket. Few other mitigating circumstances such as a collision but the driver had a clean record but was not an ass or anything.

But this was the first time I have seen it happen unless the guy was a ass in court.

I do wish it happened more frequently though.

No




Entrapment is when the police induce someone to commit a crime who would not normally commit said crime.
Asking someone who is a drug dealer to sell them drugs is not entrapment.

It will show up on your driving record and the MTO will most likely suspend our license for 30 days as they consider this a significant breach to the graduated licensing system.


Tough to beat as a roadside instrument was administered and this showed a presence of alcohol pus there was your admission to drinking. It is not just the cops opinion ...

If you have been charged DO NOT contact the other driver. You could actually be charged with a criminal offense for doing that.

It will all come out in court and you will be able to challenge the evidence and witnesses then.
