Unrelated but sort of related. Your right you cannot be convicted of impaired driving and over 80 but you can be charged with both and court even fought on both. If found guilty the judge will decide which one your guilty of.

Actually is is a summons and gives an automatic court date. The 15 days does not apply. It IS automatically going to court unless the person pleads guilty on the first court date. Plus the officer will not be there on the first court date.

It is a criminal prohibition that is handed down by the courts. Ontario Gov't has noting to do with it other than following the courts direction.

Criminal is federal and to get a criminal suspension you need to be convicted in criminal court of over 80 or impaired driving etc.

Plus we also lay criminal fraud charges. It is about the ugliest CAIA/HTA driving charge there is.

Yes they can. happened today with a red light ticket. Few other mitigating circumstances such as a collision but the driver had a clean record but was not an ass or anything.
But this was the first time I have seen it happen unless the guy was a ass in court.
