Scenario
- 2 vehicle accident
- each vehicle has less than $1000 damage
- each vehicle has damage roughly equal to insurance deductible
- a police Accident Report was completed

According to the Insurance Act, if you're planning on filing a claim, you have seven days from the time of the incident to report it. If not, no report is required UNLESS the insurance policy says "you must report all damage or collisions." That's rare, though. Check your policy.

Long story short, I was in the court today, the JP sentensed me guilty as charged, despite the fact that the sign is INVISIBLE from 60 metres in Summer ( I have shown the pictures that I took) where there are lots of tree brances and leaves, while the law says the signs have to be visible AT ALL TIMES from 60 metres. The ticket was in Winter time ...

{If it does go to trial, this is what I'd suggest: Keep a copy of the section you were charged under. You'll get to cross-examine the officer. Ask him to describe where the other traffic was, what you did, etc. Basically you want him to state that there was no traffic for you to yield to, and the road to your right was closed. Every ticket issued in Ontario that carries a set fine is invalid.
POA s. 8 allows you to settle out of court by paying the set fine.
However, the ticket you were issued informs you that you must pay the total payable.

The Supreme Court of Canada ruled in 1987 that cops can stop you for any reason and check documents. However Bear is incorrect when he states there is nothing illegal in them searching your car for any reason. .

One last Question if I may... My friend was also charged with no insurance. He does however have another vehicle and insurance..
I'm told there is a grey area there regarding that as it is the driver that is insured and the vehicle is a triviality.
