Re: on the news; license plate covers - ILLEGAL da daaaaa

This is generally not a problem with the busier regional police services: Peel, Toronto; but when you go into butt *EDIT* Ontario, OPP will look for everything under the sun. The clear plates also yellow over time, and do obstruct the plate. It also diminishes the reflectivity of the original license plate.

The Highway Traffic Act is pretty clear ...

Re: HTA 144(18)

You were not charged for making the turn contrary to a prohibited turn sign. You were charged for failing to come to a complete stop before making the red light right turn.

The Streetview image from Aug 2014 shows the lane markings on the DVP offramp: https://goo.gl/maps/UFhpr https://goo.gl/maps/N0f3p

How are you misinterpreting this lane marking to mean "turn into the middle lane"? A U.S. or Out of Province Driver will look at the sign and lines painted on the ground and turn into the middle lane?

Only the locals ...

Showing the justice of peace proof of insurance or your pink card will not get the charge dropped. You're being charged with failing to surrender your insurance card to the officer upon request.

Re: Wording un 4F form application

The reality is that the remedy for disclosure issues is that you receive disclosure. The courts do not grant stays because the crown has not met their disclosure obligations. If the items requested are relevant, then the courts order the prosecutor to give you those items. If as a result of multiple disclosure adjournments your trial date is in 11b ...

Re: If a cop claims that your speed was 84 km/hr in 60 zone

I just read through the other three pages. It appears you may win or have the case withdrawn; the problem is that you're going about it the wrong way.

Can you provide us with a scan or a type out exactly what was provided to you in the "narrative text"? Please make sure sensitive information is not included (ie. officer name, badge number ...

Re: If a cop claims that your speed was 84 km/hr in 60 zone

You need focus on the essential elements the crown needs to prove in order to get a speeding conviction.

For an Ontario Speeding Ticket, the only disclosure items you need to ask are in the sample form here: http://www.ontariohighwaytrafficact.com/topic2959.html

* A full copy of the officer's notes, typed if not legible;
* If short-form writing ...

Here's a sample disclosure form: http://www.ontariohighwaytrafficact.com/topic2959.html

You can remove the part about speed measuring device and submit it as is. Or include the additional details from RadarIdentified's post. TicketCombat also has a copy of a disclosure form: http://www.ticketcombat.com/step4/disclosure.php you can also modify it ...

Re: 80 in a 60, disclosure not very helpful

That is a VERY popular speed enforcement point for TPS: https://goo.gl/maps/7om1P

I see them there almost every single day, i'm surprised you were able to speed up that quickly after making a left turn. It's best to drive at or below the speed limit here at all times especially going eastbound.

As for your hill argument, it's a pretty shallow ...

Re: Need help for people never met ticket

The other driver is still a witness, he will not be an independent witness because he is involved in the accident. You or your legal counsel will have an opportunity to cross-examine the driver at trial and ask him questions about his testimony, and what happened.

His testimony and your testimony will be given equal weight and a decision will be ...

Re: Need help for people never met ticket

The officer laid the charge based on the description of events, the other driver who you made contact with will be the witness.

That driver will be subpoenaed and be present at your trial date. The officer who wrote the ticket will not be present. The other driver's testimony will be used to convict you.

You should request disclosure, and go ...

My understanding was that he would only have one chargeable claim against his policy. He can't be discriminated for the damage. So this would count as his first at-fault accident.

Whether he crashed into three cars or had a minor fender bender, the consequences are still the same?

If OP has 1M liability, is it for each accident? So if Driver 1 ...

Re: Being sued by my passenger

I would not take this personally, the civil lawsuit is to extract money from your insurance liability. In order for her to go after your insurance, she needs to sue you. Your insurance company will then hire lawyers to defend you and take over the case.

Normally drivers in Ontario have $1M policies, but you're also allowed to have a minimum of ...
