Re: on the news; license plate covers - ILLEGAL da daaaaa

This is generally not a problem with the busier regional police services: Peel, Toronto; but when you go into butt *EDIT* Ontario, OPP will look for everything under the sun. The clear plates also yellow over time, and do obstruct the plate. It also diminishes the reflectivity of the original license plate.

The Highway Traffic Act is pretty clear ...

Re: Wording un 4F form application

The reality is that the remedy for disclosure issues is that you receive disclosure. The courts do not grant stays because the crown has not met their disclosure obligations. If the items requested are relevant, then the courts order the prosecutor to give you those items. If as a result of multiple disclosure adjournments your trial date is in 11b ...

You need focus on the essential elements the crown needs to prove in order to get a speeding conviction.

For an Ontario Speeding Ticket, the only disclosure items you need to ask are in the sample form here: http://www.ontariohighwaytrafficact.com/topic2959.html

That is a VERY popular speed enforcement point for TPS: https://goo.gl/maps/7om1P

The other driver is still a witness, he will not be an independent witness because he is involved in the accident. You or your legal counsel will have an opportunity to cross-examine the driver at trial and ask him questions about his testimony, and what happened.

The officer laid the charge based on the description of events, the other driver who you made contact with will be the witness.

That driver will be subpoenaed and be present at your trial date. The officer who wrote the ticket will not be present. The other driver's testimony will be used to convict you.

I would not take this personally, the civil lawsuit is to extract money from your insurance liability. In order for her to go after your insurance, she needs to sue you. Your insurance company will then hire lawyers to defend you and take over the case.

Normally drivers in Ontario have $1M policies, but you're also allowed to have a minimum of ...

What was the speed limit? It's very important you check the fine on the ticket, if it's incorrect then you could have the ticket quashed.

It appears you've received some disclosure? Was there evidence of when the officer tested his radar unit? Did you request disclosure? What did you request for? What did you receive?

If you retain legal counsel, they can do all of the above without you being present. They will act on your behalf, and will do what's in your best interest.

Unless you give them specific instructions like, "no plea-deals, go to trial".

Although you're requesting for a good firm, speeding is one of the most difficult charges to beat going through a full blown trial.

In most cases these firms will take $1000 and get you a plea-deal for +49km/hr.

This is something you can do on your own.

Enforcement officers have to be pragmatic when it comes to enforcing laws while they're en-route to an emergency.

#1 you should only be temporarily in the left most lane in order to pass vehicles to your right. At no point should you be "travelling" in the left most lane unsure of whether there are vehicles to your right. You should have heard the sirens and seen the emergency lights well before they were right on top of you. For me this spells out very poor ...
