Many many cases have been thrown out because officers have laid FTC in rear-end collisions. The appropriate charge should have been Careless Driving. Just because there was a rear-end collision, doesn't mean the driver was following too closely.

Failing to stop for a red light is an absolute liability offence in Ontario. The courts are only interested in whether she stopped or not, they don't care why she didn't stop.

Speeding is an absolute liability offence, the courts are only interested in whether you were speeding and by how much. Why you were speeding is not relevant unless it was a life/death circumstance.

I recommend taking a look at the G1W, there are a few variants G1W-C (capacitor), G1WH (wider lens).

For the relatively cheap price of ~$40 it shoots really good day & night videos.

Unfortunately you can not recover the costs of impounding your vehicle and license, even if you're found not-guilty at trial or have the charges withdrawn.

So we just came back and the new sitting prosecutor also said that laser devices only need to be tested either before or after. They don't need to be tested twice.

She said that R. v. Sepiashvili [2003] O.J. No. 3996 says that the Justice of Peace can be satisfied with only one test being performed.

I returned from the Newmarket Court House with a family friend last Friday. OPP officer & sitting prosecutor told us that the officer did not need to test the Laser Ally after the traffic stop. The manual only requires them to test the device before the traffic stop.

I recommend choosing option 3 - trial and if there is a box, check off that you want the officer to be present. Once you get your notice of trial in the mail, submit a disclosure request at the prosecutor's office: officer's notes & copy of the manual for his speed measuring device.

If you can convince the sitting JP that testing times are required, then yes.... you're successful. But if the same JP has been convicting drivers for the past decade without testing times, I don't believe any amount of sister/brother JP decisions will persuade them otherwise.

R. v. Schlesinger was made by Justice of Peace Cuthbertson, and although his decision was well written and persuasive it is not binding at your trial. Your trial justice of peace does not have to consider it at all.

On what grounds are you getting this appeal? What happened at the first trial? I'd be very surprised you were able to successfully appeal due to a missing second test time in the notes.
