Re: Parking Lot Collision

I'm familiar with this area and plaza, I believe the collision occurred here: https://www.google.ca/maps/@43.7590251,-79.7282888,3a,15y,317.5h,89.17t/data=!3m4!1e1!3m2!1svr2WVSBhxJJ59xFs-TnupQ!2e0

Parking lot collisions are NOT 50/50, you need to stress this to your insurance company.

Demerit Points Table: http://www.e-laws.gov.on.ca/html/regs/english/elaws_regs_940339_e.htm

HTA S144 (9) carries two demerit points.

If the offence was allegedly carried out in an intersection... then the crown has numerous zero point charges they can amend to; a popular one is S144 (12).

As stated above, you have nothing to lose by fighting ...

A few years back, a family friend received a warning ticket from Peel Police for doing a rolling stop at a new stop sign.

This was the warning ticket; it only had the vehicle's license plate written on top.

Make sure you didn't receive an electronic ticket, because those don't require signatures. If it's not electronic then the paralegal IMO has acted in bad faith; the legal counsel you chose appears to be incompetent.

If you or your representative appear in court, they will amend the offence notice with the signature and you'll be found guilty of ...

That's not entirely true, I was in a vehicle with a family friend and we were caught speeding 85 in a 70 zone. The average speed on this road is ~120 to 130km/h.

We were very surprised the police set their enforcement threshold so low. It was a divided major arterial road, with no pedestrian sidewalks. It literally looks like a 400-series freeway ...

You can resubmit a new disclosure request, this time highlight the short form writing; ask for it to be explained or written in plain English for you to understand.

I'm not a fan of this arbitration process, it's already silently being used in major GTA cities: Mississauga, Brampton, Vaughan, Burlington, Oshawa. With the Provincial Offences Act if you received a parking ticket, there would be a 'Notice of Impending Conviction Notice' sent to your address.

I think it's best that you request disclosure: officer's notes and manual for his speed measuring device. Sample disclosure form can be found here: http://www.ontariohighwaytrafficact.com/topic2959.html

Depending on the jurisdiction, registered mail may not be an option. Ex: City of Toronto requires you to include a phone # or e-mail so that you pick up disclosure in person.

You can certainly include the resolution meeting date in your disclosure request. The crown requires 6-8 weeks to process disclosure requests. If you don't receive it by the ...

Misspelt name is not a fatal error, however your set & total fine appear to be in error.

Set Fine = $6 x 33 = $198
Victim Surcharge = $35
Court Fee = $5
Total Fine = $238

Search up London v. Young and go the forced fatal error route.

I'm also interested in this, because I've seen what appears to be heavy trucks even dump trucks do U-Turns when they approach 'No Trucks Sign'. I've also seen them pull over with their hazard lights and simulate fake breakdowns as soon as they see police officers. But I've never seen our local police stop these trucks for disobeying the sign.

You're much better off buying front a license plate bracket, keep the receipt; take lots of pictures of your car with the plate installed. Explain why you had your license plate unattached to the prosecutor. There is a real chance the prosecutor may actually withdraw the charge.

The courts actually have a grace period of 20-30days for defendants to respond. After about 20-30days you should contact the court/ticket-office and inquire about the status of your ticket.

Don't expect anything in the mail, as soon as you're convicted you have a small window to appeal. You have to do your due diligence and stay on top of the ...

Forget that link, just go to the ticket office where you filed your ticket for trial; they will take your transcript request. The costs depends on how much was actually said during the adjournment; if it was a few minutes than you're going to spend less than $20 for three copies.
