I got a camera ticket today. It states that I failed to stop at a red light and I also went through the intersection. In reality, I turned right to corner shop. I had 2 passengers in the car with me that day and I have a receipt from the shop to prove I turned right.
You have to come to a stop to make a right on red.

Re: Speed trap on private property marked "no trespassing"
Whether or not the officer was standing on private property is going to be irrelevant. That's an issue (if there is one) between the property owner and the officer.

Re: 4 demerit pts suspension - Insurance Driver's Abstract
1. How long will this appear on my drivers abstract should I want to get a car insurance again. I am getting a lot of mixed answers to this (2/3/5 years). I am looking at buying a house in the suburbs in maybe 1 year (2 max), and would probably like to get a car at that point. I can bus it as long as I need to but it would be nice to know when ...

Re: Careless Driving & Witness Notice to Court
But from what you telling me, people charged with S. 130 HTA walk away without major slap on the wrist for being stupid enough to run a Red light and to hit another motorists. That's a shame, and by me being called to court this ignorant woman is going to try and say she did not do anything... Well this is pretty amazing, man this is unfair of the ...

Re: Careless Driving & Witness Notice to Court
Can someone explain the primary reason as to why I'm being called to court if the driver was already given a ticket since the report did include a POT#. Or am I missing something here? And in such case does it mean all the other people who gave witness statements to the police will also be called to court? And lastly can the driver attempt to get ...

I would be in the little/no history category ...
The sense I get, is there is a lot of pressure from other vested parties, politicians etc, to secure convictions for stunt at trial. So I would suspect the bar is quite high, higher than normal for sure, to get the charge dismissed.

Re: STUNT DRIVING AT NAPANEE COURT
A) is this possible , to plead guilty to the charge without any suspension for a year
A conviction for stunt driving doesn't carry a minimum suspension. Maximum is 2 years. So you could be looking at anything in between.
B) is it worth getting a lawyer or paralegal or should I just take the deal

How does this affect my driving insurance and stuff
Are you a licensed Ontario driver?
If it's a regular speeding ticket, it'll impact your insurance no different than it would in Ontario. Since there's a reciprocal agreement for this charge, it will show up on your abstract as if it happened in Ontario. Demerit points will be added by the MTO ...

I'd say it depends on the circumstances. Someone who speeds 50+ (stunt label or not) would probably be silly to not consider any reduced charge that puts them 49-. It's the difference between paying 5% extra on insurance vs 100 ...

Re: Stunt driving charge at officers discretion ???
-- laws being applied equally would be a pretty strong argument ... that's kinda the nail everything hangs on. -- "Who gets a break", is a decision for courts not an officer. I doubt officers have any significant level of discretion. [/size]

Question: my insurance is with allstate and after receiving the ticket and this is my first ever offence, I was wondering if I just pay the offence and don't inform insurance, will this all in all affect my insurance I currently have and will my insurance find out about this? Anyone that has allstate too can you advise me on this?

Let's pretend an officer MUST charge someone (they don't). What's the argument? That no one should get a break?gbs wrote:Trying to determine if, an officer MUST charge stunt, by law, if a vehicle is "50+ over" the posted speed limit.

Re: Stunt driving charge at officers discretion ???
I've seen people say this over the last couple days here, how it's not "in the spirit" of the charge. The word "racing" then comes up and I guess the assumption is that because there aren't cars battling each other or it doesn't involve a kid in a fart can honda civic that the charge isn't doing what it's meant to be doing.

Re: Stunt driving charge at officers discretion ???
I'm not even sure what we're arguing here.
If you've committed the offense, what's the difference? You aren't losing anything. You either get a freebie or you don't.
As for the officer being "judge, jury, and executioner", it has nothing to do with him. If you're charged with stunt driving, you get suspended, towed, and impounded. He didn't ...
