I got "notice of time and places of hearing of appeal" and the time I got was 2:15AM for March 30th 2016 on the paper sent to me on February 5th 2016. A month later on March 2nd they sent me another letter saying the actual time should be 2:15PM. Is there a way I can use this "error" to postpone the trial?

sorry for reviving this thread as it is also the reason I signed in. Got pulled over crossing Michigan to Ontario because of my radar detector. The OPP apparently has a RDD and even if I was just at speed limit, he confiscated my V1 and gave me cad$ 170.00. I plan to choose option 3 appear in court and have officer appear in court.

This is probably what you'd consider an "officer discretion" ticket. There's no guideline to say what is and isn't effective enough in reducing spray back. At that point it's up to the officer following behind to make that call, similar to a loud exhaust ticket.

The officer just has to witness it. If you're asking whether or not he'd have to provide photos or video, the answer is no (unless it's available). He'll likely recount what he saw and that's about it. The same could be said for most tickets discussed here.

How did he possibly see that you didn't wear your seatbelt when you were driving 100km/h (im sure you were going faster) on the highway?
He could have followed from behind, looked though the back window, and took note of the position of the belt on the pillar. In that case, speed is irrelevant whether it's 30km or 100km.

Ontario is pretty strict about plates. You have to have an issued plate completely unaltered and 100% visible.
