Re: Big wall with hidden cop car behind it

Agreed. Turn not in safety is a bit misunderstood. When you're turning across traffic, it's your responsibility to only do so when it can be done safely. So you're still expected to pick up the slack for other drivers mistakes if you're maneuvering across them. A similar mistake that comes up frequently is when a driver has the right of way ...

Re: Big wall with hidden cop car behind it

While there are exemptions for emergency vehicles to travel through red lights, they are still required to come to a complete stop before they can safely proceed though the intersection.

Obviously, this happens very rarely and I think most people are satisfied if they just proceed with caution.

I highly doubt there's a ticket waiting for you here.

The day you were charged doesn't mean much unless you're talking demerit points. The points associated with your charge start from the day you're charged and last 2 years. If it takes 6 months to be convicted, the points will show up on your abstract 6 months later and last for the remaining 18 months. If you're concerned about insurance, the day ...

Re: 70 km/h in 50 km/h - Cop was wrong...

Issue 1 isn't an issue. If there's no sign, the default limit is 50 in built up areas. Flow of traffic doesn't mean anything and doesn't correspond to anything in the Highway Traffic Act. You are either speeding or you are not. That's all they need for a conviction.

Issue 2 is speculation. There's nothing in your explanation that describes when ...

Agreed with the others. Blocked view is not a defense. If you can't see without pulling your vehicle into traffic, the next step would be to turn around and take a different route. Although, realistically I don't expect many to do this. However, now you're stuck at fault for the accident.

I'd have to disagree. There's nothing broad about law covering radar detectors in Ontario. You can't have them in your car, period. They can't be in your trunk, they can't be in a box, they can't be under the ...

This kind of thing would be regulated by municipal by-laws where you were charged. There's no flat fee chart covering the province.

I'd agree with screeech. They'll take a look at the situation. Doing 190 in an 60 is one thing, 151 in a 100 is another. If you haven't pulled this kind of stunt before, i'd imagine they might drop it to 49 and under. While it was still stunt driving, it wasn't enough for the police to put out a blurb for the newspapers.

Re: 98 in a 50 -- countryside roads, please read context!

You'll probably be offered a reduction and it will have nothing to do with your story or the context of the situation. You sped up to overtake a "very slow" Accord doing 40-50km (a.k.a the speed limit). It's not exactly a sympathetic explanation, but it's irrelevant either way. Speeding is speeding. If a reduction is what you're looking for, you ...

This idea that you'll possibility have your BAC above zero charge reduced... you should probably let that go. It's a condition of your license and it's alcohol related. I'd agree with the other posters.

There's no requirement for an officer to show you the device. Suggesting they kept the number on there to charge you would be ignoring the fact that they could just write down any number they want anyways. Officers don't have to prove their case at the side of the road. That's what your trial is for.

Toronto within the last 2 years has had a zero tolerance with rush hour parking. It's a good question.

The first thought is what's the minimum distance between a no u-turn sign according to the regulations. If there was (there isn't as far as I know), i'd interpret that to be the answer.

My second thought was exactly what Stanton mentioned, which was wherever the next intersection starts.

I wouldn't be so sure. Paperwork charges like showing your wrong insurance slip or leaving your license at home is no different than speeding 40km. All minor offenses with the same surcharge.

If you want, you can contact your insurance provider and ask. I highly doubt they'd drop the speeding ticket for it anyways.

When you lend your car, you lend your insurance. If there's a claim made by the other individual, your brother is on the hook. They will ding him with a chargeable accident as if he was behind the wheel.

The actual ticket and charge are a different story. That will follow you. That will have nothing to do with your brother.

The reason you received a summons is because there's no set fine in regards to your charge. There's a minimum and a maximum penalty which are to be determined. The officer can't write down a set fine (there isn't any), so that's why you have a summons date.

Red light cameras aren't used for capturing video. They don't record anything other than a few frames used for red light offenses, which isn't a concern considering the description of the events.
