I was subsequently convicted (I was not in attendance / long story).
I am appealing the conviction. My question, is do I have a case?
My defence is that you can only have one license. And since I was licensed due to residence in another state, I shouldn't have been charged with driving while Ontario license was suspended.
You got a couple ...

Re: Failing to obey stop sign + Amber light + failing to sig
Im pretty sure the light was still amber when i turned left and i was not accelerating just normal driving (you always remember going thru a red light so whatever video evidence he has would show this) and i dont recall seeing any cars around me when i had to make a right turn a block later (but may have to look at his evidence). Re: Made a left turn while school bus had flashing hazards
Sorry I had assumed this was at an intersection. You have to make the turn safely without being a danger to others. If you're behind the wheel, you should already be able to make that decision.
If others have to compensate for your turn, yes you can be charged.

Re: Made a left turn while school bus had flashing hazards
It doesn't change anything. If the bus hadn't yet stopped and you've already completed the stop, you have the right of way. You don't have to wait for the bus and at that point you're just impeding traffic.

Re: Red Light - Fail To Stop
There's no secret to making tickets just disappear.
There's two points in your post that get confusing. You say the light turned red before you crossed the line but yet you argue with the officer the light was yellow? I'm not sure I follow the reasoning there.

No. Hazards are just hazards. Even if the lights were on and the sign swung open, you could make that maneuver anyways.sunsetdrive wrote:Do I do anything illegal?

You're supposed to drive according to the conditions. You admit to speeding up in an attempt to switch lanes and causing an accident when you couldn't stop in time. You can't have it both ways. You can't ignore the conditions and then blame the conditions when you finally get into an accident ...

if you drive while disqualified, surly you are also driving with no insurance too
Not necessarily, no.
While having a valid license would be a condition for insurance, your provider wouldn't necessarily be aware of a suspended license the moment it happens. Technically, you'd still be insured.

The best thing you can do for now is get your stuff in order and get an early resolution meeting. Pay off the original fines from September so you can get your license reinstated and make sure everything is clear for you to legally drive. Do this ASAP. You can try to explain that you were unaware of the suspended license, your wife had sent payment ...

There's no grace period, but it's possible under certain circumstances that you may not be able to report the accident within lets say 24 hours (e.g. you were injured in the accident)

Why would you need to leave the scene to be able to look for your phone at a "nearby" road? Where is this phone that you need to drive away to look for it?
How close is this "nearby" road?

Re: Detailed Disclosure Request for Radar Gun Ticket
Prosecutor sees them before they are sent and can clearly see (pun intended) whether or not they are clear.
That's not their problem and it's not for them to decide whether or not you'll need further clarification.
If you have any questions, you can simply make a second request.

No, it shouldn't. You can't argue the notes aren't clear when you haven't even seen them. If you need clarification, you can make a second request.jsherk wrote:In your request you asked for typed copy, so this should have been provided initially.

School. When you take regular minor offenses and add a school, bus, children, etc... it jumps to a major offense.
e.g.
- Disobey traffic sign (minor), disobey school crossing stop sign (major)
- Improper passing (minor), improper passing of school bus, improper passing in school zone (major)

If that's the case, that information certainly should have followed you to Ontario.
I've seen some users on here who have reported about reciprocal agreement convictions and have seen the change on their abstract somewhat immediately (maybe a couple days or weeks).
I doubt you'll see anything after 2 years. I guess you should consider yourself ...

Someone can correct me if i'm wrong (i'm pretty confident though), but it doesn't matter whether or not you get your full G license before the conviction. The ticket has no impact on your insurance. It doesn't go on your abstract, so consider it an expensive parking ticket.
You don't have to call your insurance company and you don't need to do any online quotes. Ignore all that.

What I meant was if you go through with your trial in a couple weeks, it's not going make a difference. If you go in asking for a reduced charge, they'll probably ask you about prior convictions. In that case, it might matter. They aren't going to hand out reduced charges to habitual offenders, but even then one other minor speeding conviction isn ...

Just go to an early resolution meeting and they'll likely offer to drop it to 29km.
Yes, with a G2 you'll have your license suspended for 30 days as the charge currently stands.
