On a speeding ticket I chose Option 2 - meet a prosecutor.
I never heard from them until they suspended my license. I will now pay the fine in order to get my license back as soon as possible but I want to fight this. How do I go about it after the fact ?
You already asked this question and you got the perfect answer. Go to the courthouse and ...

Re: Rear End Collision - Careless Driving
I know that Careless Driving is really hard to prove, so what type of proof do the prosecutors usually provide for this case scenario where the defendant is at fault?
How about you hit a car from behind which means you were too close to the vehicles in front of you and you didn't leave enough space for this very scenario?

Re: Speeding 403 176km/h
I got 149km'h over 4 points and $343 ticket I was told points will be erased next dec. What to expect from insurance.
Insurance company doesn't care about points because they don't use them. Generally, you'd want to avoid any 50 and plus conviction because the difference between 49 and 50 can be huge. As already pointed out, it will depend on ...

Re: Red light ticket Brampton
Red light offense is an absolute liability. Your defense will have to be "I never ran a red light and here's why...".
Technical errors that would effect your ability to defend yourself and Defence of Necessity are your last two options. So either there's an error on the offense so blatant that it makes it impossible to defend yourself against the ...

Re: How can I best defend myself
Careless Driving is not an easy charge to defend. It's not so clear cut when it comes to debating what is careless and what isn't.
There's a possibility that you will be offered a plea deal in exchange for your guilt. Your defense of "the driver hit the brakes in front of me when he should have just went" is not going to win anyone over. You have ...

Re: From 40 over to disobey sign
The cop made a mistake on the type notes: wrong postal code and wrong drivers license.
The original hand written notes are correct regarding address and drivers licence number. However, the typed notes (second disclosure received) have the mistakes.
Can I argue this? Will this be grounds for dismissal?
They wouldn't be a valid argument on the ...

Re: Disobey a Stop Sign/Fail to stop
Officers don't get to pick and choose when they want to attend court. They will be there unless there is a valid circumstance that would prevent them from attending.
If your goal is to simply check if a reduced charge will be made available to you, you can request either an early resolution meeting or a trial. If there is an opportunity to further ...

Re: parking in a handicap space
You'd have to look up your local bylaw on how designated handicap spots are treated. Some cities/towns will make mention of pavement markings and their required colours, others will have no such requirements. If the officer claims there doesn't need to be markings, there's a good chance he's correct. You can always double check to make sure, though ...

Re: Improper Left Turn
Also, I have a dash cam and have the video and audio recorded. The video shows that no cars were turning right (very clear). While the cop told me to fight it in court (overtime $$$), I am very interested in doing so now, just to bring the dash cam evidence to prove I was not performing an "unsafe/dangerous turn" and to show his unprofessionalism ...

Re: 100 in an 80, reduced from 119
Isn't attending court and trying for a reduced charge fighting it? I don't need it thrown out but dropped to 15 over. Would they not be of help?
Depending where the court is, there can be around 30 people with the same trial time and court room as you. They will all line up and the prosecutor will look up the charge one by one and see what they ...

I have an appointment for a consult with points coming up to get their opinion, but its their business to take clients so Id like to hear what people here have to say.
Points generally will not make any attempts at fighting your ticket. They will attend court try for a reduced charge. You can accomplish the same thing yourself by showing up for ...

Re: Do I have any options?
I had a same question. How long can you wait out before you accept the prosecutor's offer? If you say you will plead not-guilty and then when stand on trial and the JP asks what you plead, can you then say that you plead guilty to 10 over the speed limit?
The Prosecutor will let you know what deal they are going to offer (if any). If you need ...

He asked me why I had called my brother instead of the police. I said because I was 1 minute away from his house, and he was expecting me.
This is a legitimate question, not that your intentions were to avoid the police. Once you hit the sign and cause any damage to public property, it's your obligation to notify the police. While you weren't ...

Re: Graduated Licensing and Convictions
Demerit points last 2 years and are calculated from the day you were charged, NOT the day of your potential conviction. They are not on your abstract till a conviction, but will remain 2 years from the day you initially received your ticket. If it takes 6 months for a conviction, you will only see your demerit points for a year and a half.
