I know that Careless Driving is really hard to prove, so what type of proof do the prosecutors usually provide for this case scenario where the defendant is at fault?

How about you hit a car from behind which means you were too close to the vehicles in front of you and you didn't leave enough space for this very scenario?

I got 149km'h over 4 points and $343 ticket I was told points will be erased next dec. What to expect from insurance.

Insurance company doesn't care about points because they don't use them. Generally, you'd want to avoid any 50 and plus conviction because the difference between 49 and 50 can be huge. As already pointed out, it will depend on ...

Careless Driving is not an easy charge to defend. It's not so clear cut when it comes to debating what is careless and what isn't.

The cop made a mistake on the type notes: wrong postal code and wrong drivers license.

The original hand written notes are correct regarding address and drivers licence number. However, the typed notes (second disclosure received) have the mistakes.

Can I argue this? Will this be grounds for dismissal?

Officers don't get to pick and choose when they want to attend court. They will be there unless there is a valid circumstance that would prevent them from attending.

You'd have to look up your local bylaw on how designated handicap spots are treated. Some cities/towns will make mention of pavement markings and their required colours, others will have no such requirements. If the officer claims there doesn't need to be markings, there's a good chance he's correct. You can always double check to make sure, though ...

Also, I have a dash cam and have the video and audio recorded. The video shows that no cars were turning right (very clear). While the cop told me to fight it in court (overtime $$$), I am very interested in doing so now, just to bring the dash cam evidence to prove I was not performing an "unsafe/dangerous turn" and to show his unprofessionalism ...

Isn't attending court and trying for a reduced charge fighting it? I don't need it thrown out but dropped to 15 over. Would they not be of help?

I had a same question. How long can you wait out before you accept the prosecutor's offer? If you say you will plead not-guilty and then when stand on trial and the JP asks what you plead, can you then say that you plead guilty to 10 over the speed limit?

Demerit points last 2 years and are calculated from the day you were charged, NOT the day of your potential conviction. They are not on your abstract till a conviction, but will remain 2 years from the day you initially received your ticket. If it takes 6 months for a conviction, you will only see your demerit points for a year and a half.
