Re: Two tickets need advice

I know I only have a week to pay the second ticket but I don't want it to show up on the record for the early resolution so I was thinking of asking for a trial to delay the conviction to keep it off the record and having better luck with the 30 over tickets.

As already pointed out, having another speeding ticket isn't going to make or break any ...

Does the fact that the driver needed to speed up to hit me make any difference?
It was not necessary for him to slow down to avoid the contact, but being he accelerated caused the contact?
That part does not make sense to me.

Right of way trumps all. He was free to go straight, signal or no signal. He can just say he changed his mind and ...

Ultimately my state does not have a reciprocal arrangement with Ontario, but I don't want a conviction to be held against me on the basis of insurance fault - as i was driving my father-in-laws car. OR i would just pay the ticket, b/c points will not follow me.

Re: Interfere With Traffic Ticket - Advice Needed

I'd like to fight it if possible because I'm pretty annoyed at this cop setting up shop near a major accident and using it to pull over car after car after car.

But it's not annoying to everyone else when you block a direction of traffic instead of waiting? You can't go anyways, so why block everyone else from moving? There's no reason traffic ...

You do not need a phone number. If they say you need a phone number, tell them you don't have one. You don't have a number, but you have a mailbox. Your license doesn't have your phone number, your ticket was most likely responded to by mail, and your Notice of Trial was sent by mail. You have gone through the whole trial process without a single ...

Re: Received 3 demerit points in Quebec on zero tolerance

Today I was driving in Quebec and a cop ticketed me for 132 in a 100 zone. Which is 3 demerit points.

It's actually 4 points. Quebec and Ontario have a reciprocal agreement which means your offense will be shared between the provinces. The offense will transfer, the point will not. Ontario will take the charge and apply it to the system here and ...

Not going to happen. You already got a huge break as is. If you want a trial, your ticket can be amended to its original speed. If I was a prosecutor, i'd tell you to take it or leave it because you DO NOT want to go to trial.

You haven't asked for disclosure. You don't know for certain where your speed was recorded. You are assuming things by what you saw. That information would be located in your disclosure. You can't just assume these things going into trial.

My trial is next month. I didn't get disclosure cause I thought this could increase the odds of the officer showing up. I've been in court once before and noticed there were 1-2 cops only for like 12 cases? So it seems like cops don't show up the majority of the time. Then again, this was an OPP officer. Agreed with what was already said.

Ticket goes to the owner of the plates. They don't care who plans on defending against the charge because the ticket will always be the responsibility of the plate holder. You should resubmit your 11b and be prepared to solidly argue why the delay should be attributed to the prosecutors office. I personally see nothing wrong with not including a phone number but I would be prepared to argue why you feel it is not necessary.

If you don't receive the disclosure you want, you will also have to argue that why you feel ...

This is a drag up from the past, but I thought I would leave some input here.

Driving a car on the street with a rollcage and without a helmet could potentially be dangerous. If you got rear ended and bounced your head off the main hoop, you'd most likely bust it wide open.

You aren't the only one to raise questions about the way people are charged with regard to street racing. It's been a hot topic throughout the years and there's quite a bit of case law regarding this topic.

Rulings have gone back and forth for each side. As it stands now, it's perfectly legal to impound a vehicle on the spot. Although if it's any ...

By my logic, tickets from other provinces should not count towards a higher insurance as there is no memorandum of understanding (that I know of) that state that the Manitoba Highway Traffic Act is equivalent to the Ontario Highway Traffic Act.

Provinces along with many U.S. States share a Reciprocal Agreement. Your ticket in another province or ...

This whole "the officer is not going to show up" thing is completely overrated. He is going to be there almost always. He cannot simply just not show up.

As already stated, speeding is an absolute liability. What that means is you are either speeding or you aren't. They aren't interested in hearing excuses to why you were speeding.

Even if they could take into consideration your current defense, in my opinion, it's absolutely terrible.

Re: 80km/h in a 50km/h zone

Speeding is an absolute liability offense. What that means is you were either speeding or you weren't. Your defense has to be " I was not speeding and here's why...". Saying you were doing 78 and not 80 is not a defense for an absolute liability offense. All you're telling the court is "I'm guilty and please ignore everything i'm about to say".
