Unless they were parked WAY behind the entrance, they probably could've seen if anyone made the turn. If the officer shows up for trial, he'll testify that he clearly observed you make the turn. To fight his testimony, you'd have to take a photograph from exactly where he was standing/sitting and show that it would be impossible for him to observe ...

Some motorcyclists insist that their loud pipes are a safety necessity, so that people will "hear them coming," and react accordingly. Yeah... sure...
Doesn't work too well for emergency vehicles with the siren blaring so I don't know why they think a loud muffler will make any difference.

The officer does not have to directly observe the sign itself at the exact moment of the offence. They do have to observe the offence . Example: Sometimes they'll sit around a corner where there is a "no right turn" or "no left turn" sign, or whatever, and nail anyone who makes the turn. That's enough to get a conviction, usually.

Missing signature is a "fatal error," so yes it will be dismissed. The officer simply writing his/her name at the top of the ticket is not sufficient. OOPS. Fight it. Check out this explanation:

Don't forget to find parking, lets drop 20 minutes off the travel time for the 401-DVP-Queens park route and 48 minute to travel 118KM. Lets see 6 goes into 48 8 times........divide 118 by 8 and multiple by 10 and survey says 147.5 KM/H "average". Nope he never even came close to 150..........

Yes, Quebec has similar laws, but they actually didn't try to hide anything about it, they said it was to deal with "excessive speeding." They also don't have a vehicle seizure for the first offence, just a roadside licence suspension. People do drive extremely fast on the 400. When I hear people complain of crazy driving on the 401, I usually say: "Yeah, it's a little challenging... but if you think that's bad, try the 400." Wide road, long commutes, and a higher police tolerance for speeds. If they stop and tow the guy going 150 they'll miss the guy going 180+.

In the disclosure request, also ask for the officer's driving and disciplinary record. If he has a history of this sort of behaviour it weakens his credibility on the witness stand.
