Re: Discussion - Front license plate

It's in the general penalties section of the provincial offences act, standard is $85 plus cost and surcharge totalling $110, but extenuating circumstances (previous convictions etc) can raise that to $600 in court, plus cost and surcharge. I had a fella here who just refused to put on cause he didn't like the look of it on his sportscar, third ...

Re: Failure to Provide Insurance Card

Unfortunately you are required to surrender a proper (not expired) insurance card. Granted you could plead not guilty to both, and attend court to try to negotiate one away. However, even if you find by the time he or she has returned with the offence notice written, you have no real defence. A valid insurance card is required upon demand to the ...

Sometimes there's a delay in receiving the ticket at the Fines Office, typically, the ticket is quashed at that point, the police service has the right to reserve you, but that SELDOM if ever happens unless this is a serious charge (MVC etc)...looks like you dodged one, keep all your paperwork, if you should get a notice that somehow you were ...

Further the longer the rake, the less downforce on your front tire...i.e. if the officer grabs your front brake to lock, and can still push the bike forward, improper means of braking, off comes the plate, it can be declared unfit and towed away, don't mess around with chopper style bikes, the cannot store or manoeuvre in emergency situations and ...

Either way is a gamble, case law says if you fight it the charge can be upgraded to the full speed...they still have to prove you were speeding, but if you are going one over, you are guilty, at that point the argument is about the amount...you sorta got a discount, the downside is your rates may go up, calling and asking them is not great, cause ...

Standard Field Sobriety trained officers act as screeners and can test for alcohol & drugs...just did the course last month, very intense week with lots of field testing on willing guinea pigs...if the tester believes impairment by alcohol or drugs then either Intoxylizer and/or DRE.

Re: Speeding Ticket

Demerit points cannot be negotiated at the court level...whatever you are convicted at is what the MTO ASSIGNS YOU. So the trick is to get the speed reduced to reduce demerits or best scenario is go the for a 15 over (no points).

Most prosecutors are pretty flexible if a) the speed wasn't excessive b) your record isn't lousy.

Best bet is if the ...

No, but it's always in your best interest to record DL, Plate, and Insurance info as well as other driver's phone #, offer to provide yours as a show of trust.

Prob a good idea to keep a pen & paper in your glovebox with those fields ready to fill out. Even minor collisions can be stressful. There are phone apps that are good for this too.

You plead guilty and now because of that outcome you want to appeal? Not a chance a justice of the peace will grant an appeal on those grounds.

Sadly your version of the events indicate guilt. You are responsible to ensure you validation is up to date before you drive any vehicle.

Sad that you are out there with a measuring tape to ensure the sign isn't an inch to small, when you coulda been paying attention to your speed with a similar degree of precision.

Advice?

Stop driving.

People like you cause more carnage on our roads and don't deserve the privilege to share them with the majority of us who can travel at speeds resembling the speed limit.

150 in an 80, I'm thinking a 2 year licence suspension at the bare minimum.

The paralegals will hate this, but the latest case law, which was reviewed in Ontario Court, to be published soon...

I tend to disagree with Simon, which I seldom do, many of my offence notices (I write several hundred a year) over my career HAVE been amended for this omission.

The JPs tend to rule it's not a serious impediment to defending yourself.

You know the substance of the offence and the section number can easily be looked up.

Just sayin'
