Re: Confused !!

I'm not saying there's not more info, but based on the info provided I don't see a problem...If you have a view of two cars traveling side by side or one behind the other over a significant distance and you get a radar reading, they are in essence traveling the same speed.

Re: Failure To display two Plates

As a police officer I totally understand the benefits of a properly mounted plate, as a car enthusiast, I think they ruin a car's 'face'.

I getcha.

Re: Failure To display two Plates

I wish I'd have fought it, because I would've won.

well I'm not sure how you can tell what would have happened and certainly your arguement / situation is unique...what I'm saying is that I regularly get people coming to court saying "Oh it just fell off in the car wash"

As for modifying your plate, no that even worse!! That's a Part III ...

Re: Failure To display two Plates

No, IMHO you would have been found guilty.

Just cause it was torn off the day before, does not authorize you to break the law.

I've have numerous people give that 'excuse' in court, "It was torn off in the car wash"

The JP's standard reply is, 'then you don't drive it til it's repaired'...if you're vehicle cannot meet the equipment ...

Re: Falsely accused of hitting a car while backing from driveway

If you are 110% positive, then call her staff sargeant and speak to him/her regarding your legitimate request for information, and subsequent bovine excrement of a response from this officer. I find it really inappropriate of her to threaten you with a charge if what you are saying here is the the whole story. If I knew that I did not hit the car ...

Re: Failure To display two Plates

No, they must be displayed on the front and back of the vehicle, while it might not be in the wording it's in the annotated sections.

I had a guy try that once here, the third time I ticketed him with a summons, jp gave him a $750 fine and told him to smarten up. It was an Audi.

BTW I had a front plate on my M3 and my TT...if you don't want to ...

+1

That's what I'd do.

there are times when a paralegal / lawyer is of value, not thinking this is one of them.

Prosecutors are usually looking to make a deal.

Re: Falsely accused of hitting a car while backing from driveway

I would suggest you be firm with the officer and say "I can appreciate the other parties concerns, but my car was not involved" and politely close the door after providing them with the name of an attorney you use.

Re: Falsely accused of hitting a car while backing from driveway

What the officer said is true and without actually being there at the time of the collision I can't say...

I think you're issue here is that you haven't been charged so there's no allegation you did anything wrong, no driver or vehicle identified. I'd just wait and deal with this with the insurance.

Re: Falsely accused of hitting a car while backing from driveway

Again, I'm not sure why.

You haven't been charged, and not exactly sure what the officer told you, they may have attended your residence to find out more about you and your car, but you haven't indicated anytihng so far where you've been accused.

Re: Falsely accused of hitting a car while backing from driveway

Well it sounds like you haven't been charged. In which case you have nothing to worry about.

Contact your insurance. Advise them of the entire situation. Tell them they are welcome to send an adjustor out to inspect your vehicle.

If you weren't charged, then the police aren't causing you any grief.

I'm guessing there must be an eyewitness here ...

Re: Speed trap: SB Royal York, N of the Queensway, Toronto

The problem with variable speed limits is it creates confusion, add the clock to the issue, if the speed limit is constant, it's actually more fair to everyone...

In a perfect world everyone gets tested to their ability matched to the vehicle dynamics and we have a constant changing computer guided traffic flow where the capable can drive to their ...

You can attend you local fines office, advise them of your court date and that you wish to pay. They'll take your payment and have you removed from the docket. Or just not go, you'll be found guilty in absentia, plus a $5 court cost.

No worries, call the police officer, offer them to take a paint sample from your vehicle. Tell them flatly that your vehicle was not responsible. Contact your insurance tell them the same. Find why they suspect you. Is there a witness?

Well I appreciate any criticisms, but if you haven't work in the profession, I generally take it with a grain of salt.

We can google all day for examples in the U.S and Canada about officers not on the up and up.

In the USA there are 683,396 police officers. In Canada, 67, 436, so roughly 3/4 of a million police officers in North America. Doing, arguably one of the most dangerous jobs, stressful jobs in unpredictable situations...I agree, there's probably ONE ...

Re: What You Should Do if Pulled Over By a Police Officer

A police officer IS A PEACE OFFICER.

Turning lights on, keeping hands in view and opening the glovebox are nothing more than courtesies.

I know this may surprise some, but police have a difficult job out there. Not unlike Cst. Vu Pham who was murdered during a recent traffic stop, or Cst Joe McDonald who stopped a car on a routine traffic stop ...

Re: Expired plate that was 9 years old.

There will be no allegation other than on the date on the summons you were driving.

If you testify the crown may challenge you as to whether or not it's been driving around for 9 years, but it'll mean nothing other than to show the JP that you deserve a larger fine if you admit to doing it. Don't.

All they have it the day the stopped you...

In my experience the ticket can be amended, it is not a fatal error because you are still clearly identified by name address & dob. It does not confuse the offence time or location...
