Travelling north on Hwy 41 coming into Nappanee. Followed a car that was driving very erratically for approximately 8 km - all over road and driving between 60-70 km. Directly before you come into Nappanee there is a very short passing lane (500-600 metres). Straight stretch of road but you are coming into an oncoming hill. Of note there are no signs indicating you are coming into Nappanee - nothing - just what looks to be an opportunity to overtake a slow moving vehicle safely. As soon as I got up beside vehicle a car breaks the horizon of the hill so instinctively I sped up - apparently to 119Km - of course its a cop - he pulls over on his side of road and waves me to pull over on mine. I explain that I honestly thought the driver was drunk and was staying behind as much as possible (6/7 car lengths). I asked officer if he noticed the line of traffic behind car - he said yes. He did not have the other cars speed and told me he picked mine up off his antenna - but only had the one reading (I thought they needed two readings). He told me in no uncertain terms that you cannot speed to pass – which has been confirmed based on other posts here. The problem is that based on my calculations there is no way to safely pass a car doing 65Km while doing 80km in the amount of road allotted - not if a car comes over the hill "after" you have started to pass. It would take me approximately 14 secs at a rate of 22.22 metres/sec (308 metres) to pass a car doing 70 km while driving 80km – keep in mind there is a like car – theoretically approaching at a minimum 80 km bearing down at the same meters/sec. The intersection point occurs prior to overtaking the slower moving vehicle. Is there no onus on the highway markings that offer a passing lane (single dotted line) when it is physically impossible to do so? I can only assume had I actually done 80 km and swerved to miss the police van or simply ran head-on into him he would have charged me with careless driving???? BTW – within a 2 km stretch after my ticket I counted no less than 3 cars pulled over and being ticketed on the 401 – obviously an end of month ticket blitz. Any insight here would be greatly appreciated – I plan on fighting this.
Charged with 119 km in an 80 Km while passing....
Re: Charged with 119 km in an 80 Km while passing....
me again
- and why would they even offer a passing lane coming directly into speed reduction (80 to 60) - first thing the cop said was - lucky it wasnt 50 metres more - I would be impounding your vehicle right now?????
Re: Charged with 119 km in an 80 Km while passing....
would a "Defence of Necessity" not apply here? In my opinion if I hadn't sped up I would have run into the oncoming police van - my calcualtions clearing show that to be the case....
-a) There must be 'clear and imminent peril' calling out for action without deliberation
-b) There must be no reasonable legal alternative to the illegal act
-c) The harm inflicted by the illegal action must be less than would be present if the 'clear and imminent peril' were manifested
-d) If the harm which forms the basis for the defence was clearly foreseeable and avoidable at an earlier time without any illegality, the defence is unavailable.
Re: Charged with 119 km in an 80 Km while passing....
Obviously the officer was more focused on issueing tickets than worrying about public safety. One would think he should have thought to himself there was an impaired driver on the road who was weaving and swerving, and as part of public safety he should have gave chase to investigate, or be held accountable if a fatality had occured up the road after it was reported to him about the observations. NOPE easier to just get that ticket issued and be in good with the sargent at the end of the month.

I'm not reading a lawful defence here...

If you try to reason with the law/bylaw you will always lose.
The necessity can only happen, when you are obeying the law.
You where doing 80 and nicely passing the other cars.
Then you see the police car coming at you, so you have to speed up to get out of the way.
Take all your math stuff too.And pics if you have any.
Cheers

Re: Charged with 119 km in an 80 Km while passing....
IMO, defence of necessity does not apply here. If you were in a life-threatening emergency, yes, you could speed... BUT this scenario does not count. The reason being, you chose to pass a drunk driver. The Crown will become quite theatrical and ask, with incredulous flair: "You PASSED a drunk driver? So, you risked getting sideswiped by a driver who, by your own admission, was ALL OVER the road... and then you put yourself in front of an erratic driver, who now, if you had to stop ahead, would quite possibly rear-end you?" So the passing manoeuvre was not necessity, but choice. Also, they'll point out that the yellow lines on the roadway are only guidelines with respect to passing. The court will likely point out that if you, as the driver, saw the passing zone was too short, you should have not attempted to pass, or abandoned it ASAP. Stupid passing zone? Perhaps. But, nonetheless, it's still the driver's decision to use it or not - and a lot of your testimony is going to be used against you. When you saw the oncoming cop car, they'll argue that you should have slowed down and got back in line - not accelerated. Sucks, but that's what the law is.
This speeding ticket is best fought on technicalities (if there are any), or a plea-bargain. I just don't see how defence of necessity has a chance of working here.

149km/h on 401 WB Disclosure Notes
I followed the procedures mentioned in the previous threads regarding the disclosure and received it today. My court date is November 5 2009 in Whitby. After going through the notes I realized 2 things:
1- the notes are horribly illegible and difficult to read
2- I have notes from two different officers.
Now I am not sure if this means that both the officers will be at court for the hearing or…
Speed Trapped
I hope I can paint the picture with the accuracy that the truth deserves. I have no intention of just beating a ticket.. but more like beating a really unfair ticket. You decide!

Fatal error: Speeding 75km/hr in posted 60km/hr zone.
Hi everyone,
Need an expert advice here. 10 days ago I got a speeding ticket. Ticket has a fatal error on its face-offense not known to law. It says speeding 75km/hr in posted 60km/hr zone. What is the best way to proceed?
1. Should I completely ignore this ticket and let the JP to quash it?
2. Should I go with option 3 - request a trial and force the fatal error by not showing up at court?
Does…
DON'T HAVE A CLUE WHAT TO DO!
My name is Brian. I am in my late 20s and live in Toronto. I do not own a car but half a dozen times a year I rent one with my Visa. (To get out of the city and go to a beach or ski for example.)
I have never drunk and drive but I face a problem and Im wondering if anyone can tell me what to do. Several months ago I was at a weekend party and had quit a bit to consume. When I stopped…

Traffic stop in scarborough, ontario
I was travelling east bound on ellesmere road and approached markham road attempting to make a right turn. 123km/h in a 70km/h
Just got this last night on my way to guelph.
Crested a hill, officer coming at me, pulled a u turn and pulled me over.
I will go back and look again but I thought I was in an 80 not a 70 and I am positive I wasn't doing more than 120. My speedo read 110-115. I have aftermarket tires and rims so I assume this would be the difference.
It was around 7pm, already dark, nobody on the road but myself,…
Case Law- Disclosure of only testing pages of radar manual
I am looking for the case law that is commonly used when the prosecution says they only need to disclose the testing pages of a radar manual or laser manual.
I am only interested in the binding decisions (appeals court or higher?), and not in the non-binding Justice of the Peace decisions.

Drive While Under Suspension "Force Fatal Error"
So I was pulled over early in the AM. I was picked off in a line of cars for speeding. Lucky me!
Anyways I got 3 summons for Drive Under Suspension and 1 summons for speeding.
I didn'e have my wallet on me so was unable to present any photo id. Also, the car I was driving was a friend of mine.
The officer has incorrectly misspelled my first and last name. Also my address is wrong, I haven't lived at…
misspelled offence for failing to stop at a stop sign
Hello,
I was pulled over two nights ago and charged with failing to stop a stop sign. On the ticket, it says 'disobey stop sign - foil to stop' and does not say 'fail' -- something I think may be a fatal flaw? I have been driving for 12 years with no tickets, yet I live in Brampton where insurance prices are high so I do not want to be convicted as my insurance rates will spike significantly and…

A friend of mine (who is from China and with no knowledge of English at all) asked me to interpret for him on court.

Improper Mudguards?
Good evening everyone,
I need some help here. So today I was on my way to get my tires changed from my winter tires to my regular summer staggered set of tires. For some context, I drive a stock 2013 C63 AMG with winter tires at the time. I was never…
FTC ticket: rear-ended the lady but no damage
Hi,
I'd like to start this off by saying for the last two weeks I have been browsing the forums. I'm trying to prepare myself for an early resolution meeting with a prosecutor (in Brampton, if that matters). I have a clean record and as a teacher, I always do my best to follow rules (trying to practice what I preach!)
On December 4, 2014 I was preparing to turn right at a very busy intersection.…
Someone took a photo of my license plate
Hi,
I have question, today I was going to work in my normal route there is a triangle intersection with my side being the only one with a stop sign.
There's a car in front me who stopped at the stop sign, and the third-side there's a incoming car with their hazard-light flashing but they don't have stop sign, yet coming in at a slow speed.
Right after the car in front me went through the stop sign,…

I did not realize I was breaking any law it was a dotted line where I tried to…

Discussion - Front license plate
Let me start this with saying that this isn't in regards to a ticket, more a discussion surrounding front license plates and learning about the rules behind them. I know Ontario law/HTA mandates having a front license plate unlike some States in…
It is hopeless to fight a ticket at Ontario Traffic court
Hi Guys! I've just had my trial day yesterday. I was not at fault but was convicted anyways.
It is such a travesty! There is no justice at the traffic court. It is just a no mercy machine to part someone with his money, no common sense applies and no reasonable argument being considered. Such a shame! The justice, the policeman and the prosecutor ganged up against me. The justice kept interrupting…
Newcomer Needs Advice
Well first of all ... glad to have found the forum - hoping to find answers to 'alot' of questions
I was unfortunate in July 2010 in that I ended up rolling my 2009 Ranger three times, through a fence and landing on the roof on a rained-out road that was/is in need of proper repair in Eastern Ontario.

licensed in another province at time of suspension
I have an unusual situation.
I was traveling down the 401, noticed a speed trap, and started flashing my lights -- in order to warn oncoming drivers.
Within a 30 seconds, a car slowed, crossed the grass, and approached me from behind. Lights appeared, and I then realised that this was an officer in an undercover car.
The officer pulled me over, and while he was polite, clearly his motivation was to…
