Follow Too Close And The Guy In Front

I got a Following to Close charge but shouldn't the guy in front of me also be charged for being in the left lane (2 lane hwy)? I mean, the left lane is suppose to be for passing? There was no one in front of him, so he was breaking the law for not moving over when I approached him (and he shouldn't have been in that lane in the first place). I think.

I fight all my tickets!

Never think that way. The ticket is yours only. OHTA does not provide for someone travelling in the leftmost lane, nor does it prohibit doing so. Neither does it prohibit overtaking someone on the right lane. If you approached that guy that close it means you were travelling on the left lane yourself.


Your only defense is that if that guy was travelling at a speed lower than the traffic limit AND being in the left lane.
