Anybody have copies of most recent Genesis II manuals? I am looking for: Genesis II Select or Genesis II Select Directional - User's Manual and Installation Guide - Canada Variant Rev 25/Aug/2010 I requested disclosure, but only got cover and test procedures page. I then asked Justice that I wanted whole manual and he told me that I should have gone to a library to look at it. I even went to Law Library in University of Ottawa but they did not even have it. I went to a couple different OPP detachments to try and view them but they would not let me see them. I have sent a Freedom Of Information Request to Ministry but that will probably take a while before I hear back from them. Thanks

Don't go to the detachments. Go through the prosecutor to view the manuals. Our jurisdiction does it all the time. What's in the manual that you think will help you?

As I stated above, all the prosecutor gave me was cover and one page of testing procedures. I made a second request and he said no that was all he was going to give me. I brought it up to Justice and he said I should have gone to a library to look at manuals. Would be great if the Justice could tell me which libraries carry the manuals because I cant find any that do! Anyways, really the whole point is how do I know whats in the manual that will help me if I can't see whats in the manual? Maybe there is nothing in it that can help me, but until I read thru it, how do I know that? How can I question a police officer on his use of the equipment and settings if I do not know what they are or how they work? How can I question him on operating parameters of the unit if I do not know what they are. I could not prepare a full answer to the charge because I was denied access to the manual.

It appears that the JP has made a decision about your disclosure. See if the prosecutor will permit a viewing of the manual and be prepared to take notes. They won't permit any photocopying. As far as I'm aware, there are no copies of this particular manual available at any library or even online.

All the prosecutor is required to provide you is the cover page (so you know what device it is) and the testing procedures. They have discharged their obligation for disclosure if they do that.

I appealed the case and won... appeal was allowed so charge was dropped. The appeal addressed many issues, one of them being the fact that I did not get a copy of the manual. The prosecutor did not fight the case, just told the judge he was going to allow the appeal. Now presecutors tend not to just let you win, so obviously there were some good points that were addressed in the appeal, but I do not know what the points were that he was worried about. I am not sure what points he was concerned about, but if he had of fought the case and lost, then there would have been a precedence that everybody should get the manual. I have filed a FOI request with ministry to try and get copies. Will let you know the outcome.

"Winning" an appeal is one thing, getting off because the Crown didn't want to contest it is another completely. Besides, this is provincial offences court. No precedence would have been set.

An FOI request with the Ministry wom't get you anything. They don't have control or posession over the manual. I also agree with trenchknfe. Any decisioon mad by a justice of thr peace isn't binding on any court.

I have been reading Fight Your Traffic Ticket site and have a couple of comments.
I was issued two tickets at the same time, one for invalid left turn (Hwy 7 in Markham and Swansea). Another one, because the officer did not like my copy of registration documents.
This happened in last year (2015) April. I was going to pick up my son from Queen's University (Kingston) after his exams, and I guess I was too excited and was caught speeding 36km. The cop didn't say anything to me, just asked for my registration etc. Came back and handed me the ticket and…
Asking for input on whether I should hire someone or go to court myself.
Situation:
Was on a 60 road with a bit of traffic. Construction on the two right lanes leaving just a left turn lane and the centre lane. It was a green light so I accelerated (also writing down on my statement that I…
I got ticketed for a 72 in a 50 zone that I actually thought was a 60 zone as it was less than a km before.
I had an aggressive driver on my bumper so after tapping my brakes a few time I accelerated to merge into a different lane which was when I got caught in a speed trap.
I'm laughing my a$$ off at the scales of injustice in this town... This is a crazy story!
I'm cycling from home to work on Oct. 3 & get struck while traveling through my green light by a jeep turning right at his red light at the corner of Hwy101 & Brunette Road (Hollinger Park)!…
I was in court last week and the crown and judge agreed on a joint submittion that I plea guilty to dangerious driving. The judge commended me on the work I have done to improve myself and stated that there would be no prohibition on my drivers licence. He gave me a fine and one years probation…
Got a ticket for failure to obey sign. Essentially went straight on a right turn lane when there was a traffic blitz going south from Markham Main st past Hwy 7 east.
I received my notice of trial for July 17th but I assumed this was going to be a first appearance or is this the actual trial…
I've posted at this forum before under a different username a while back, which I unfortunately can't remember, and at that time the people who replied back were extremely helpful and for that I'm grateful.
Last night I was leaving Toronto driving north on University just north of Queens…
In early March I was driving in the Yonge & Churchil area. An officer said I failed to stop at a stop sign and ticketed me 110+3 demerits. While getting my license etc. I have multiple photocopy of my car ownership in my car, and that I thought I handed him the copy with the validation…
Hi, I am from Ontraio, Canada. I was using my friends car for moving some stuff around and was stopped by police and could not produce insurance slip. Got $65 ticket and paid it thinking not to make fuss about it. I know I made a mistake by not contesting it more so given that it was my first…
