Hello everyone and welcome to Ontario Highway Traffic Act forum. I am a moderator for the "General Talk" section, and I will help out the admin to moderate the site. Please remember that this particular section is not just about the Ontario Highway Traffic Act, you can post your favourite recipes here for all I care, or ponder whether the TML will make the playoffs... . Please make an introductory post about yourself here to be welcomed to the forum! About the forum: I, admin, and any other moderator can edit your messages, and we will if they contain any offensive material, spam, references to adult material, any hate-related or discriminatory material, profanities, attacks on other forum members, or we can delete them altogether, but if there is no offensive material there, I guarantee that the post will remain intact. If the moderation team does not like your post for any reason other than the ones listed above, we will contact you via PM with request to change your message. Repeat offenders will be notified, and if their behaviour doesn't change - banned. Spambots will be banned immediately upon discovery. Also please DO NOT POST IN ALL CAPITALS, as this resembles shouting. Posts in all caps will be deleted regardless of content. Remember that people of all backgrounds come to this site, so please do not make fun if someone misspells or makes any grammatical or otherwise error. Please, let us work together and make this yet small, but growing community, a fun place to visit time and again. Also please visit our FAQ section. The page contains a great deal of resources regarding the forum's technical aspects, login problems, and generic forum usage. Please also visit the BBCode usage page for BBCode to assist you with formatting your replies. If you get unwanted private messages (ie advertisements, not other user's messages) or any offensive material over our private message system please PM me and I will work with admin to resolve the issue, as this is likely to be done by a spammer. Also, please do not respond to these PMs in any way, especially if that mentions a web address - do not go there. Remember that neither me nor the admin will ask you for any personal information or passwords, if you get messages asking you to give away your password or any info, or contain any material you find offensive to you, please report them to me immediately via PM. Including the original message in the body using quote (if you are not sure how to use quote, see BBCode usage page, close to the end of the post) will also help. We will not tolerate abuse over our private message system, and violators will be banned. Police. We realize that you might be upset with the police after receiving a ticket. However, this is not the place to promote anti-police views or hate towards the police. The job of a policeman/policewoman is much more than writing out traffic tickets, and in no way reflects the entire police force. If you believe that the LEO had treated you unfairly or made a mistake, make a post about it to start a civilized discussion. Please Do Not Post any Police Officers' Name, Contact Info, Or Any Other Identifiable Material of the LEO that issued you a Traffic Ticket. This Forum will Remove any reference to any individual LEO that you had dealings with. This Forum is Not the place for individual Police Complaints. We understand you might be frustrated with the LEO that issued you a Traffic Ticket, but this is not the place to vent your frustration about the individual LEO. You may talk about the Police in General, but please do not name the LEO, or your post will be subject to Moderation, and a Warning will be issued to your member account. If you need more information on Police Complaint Procedures, Please Visit: The Ontario Civilian Commission on Police Services Linking out. Please do not post any links to: offensive material, spam, adult material, any hate-related or discriminatory material, terrorist organizations, virus-infested sites, adware-infested sites, any malware-infested sites. As a guideline, if you would not like to end up on the site, do not post it. Signatures. We do not allow advertisements in a signature. You can post a web link in your signature, but not an advertisement or endorsement for it. All rules applying to regular posts also apply to signatures and weblinks in signatures. Double posts. If you feel that your issue falls under 2 or more categories, select the one which is either the most applicable, or, if you cannot choose, the one which is the most severe. If you have already made 2 or more posts about the same issue, chances are that one of the threads will take off and the other one won't. The one that doesn't take off will be deleted. Also, sometimes a glitch occurs that causes your response to be shown twice. If that happens, please delete one of them. You can delete your own posts. Otherwise a moderator will remove such an occurence. RSS Feed. We have a RSS feed that shows the latest posts made on the forum. Grab it here! Advertise With Us! Banning policies

I hope that it's 30 days from registration and not just any 30-day period.

Hello

I usually get speeding tickets. Not a lot. But this time I got caught slowing. What? Yeah, thats what I said. Driving too damn slow. 32 year old...sporty little car...driving too slow. Not high. Not drunk. Maybe a little tired from a hard day at work. I was driving 10 under the limit. 80 in a 90. So....why the ticket? 10 over gets me....NOTHING. Cops don't look at you if you do ten over. They do ten over. Can I beat the charge? I sure as hell am going to try. 2 points and a 110 dollar fine. Yup. I'm fighting it. Can anyone give me some advice? And the Crown does not want to deal with me. I told her that I would pay a hefty fine...as long as I did not get the points taken off my license. She said no. I am confused. Oh well. I love the web site though.

Re: New Member? Come and say Hi and Introduce yourself here! :)

Hey y'all. I have trolled these forums before (and I suspect I know one of the admins from working together once), but I didn't sign up until today. I look forward to being a part of this community! I have taken an interest in this aspect of the law because I have had some tickets in my younger days and have learned through the experience of representing myself for all but one of them. It is one of my hobbies now, as my friends and acquaintances always come to me for advice as to how to proceed when they've gotten a ticket. I try to help them to the best of my knowledge but I am always learning! So hopefully I can contribute a little here, and gain knowledge from your contributions also! Regards, SLYK

Re: New Member? Come and say Hi and Introduce yourself here! :)

I guess I'm due for an intro post. I'm 22, living in Orillia, Ontario. I did two years of an engineering degree at the University of Waterloo, but I just couldn't sit at a desk most of the time for the rest of my career. I spent the next two years going to random lectures in different departments, but I was always drawn to law enforcement. I plan to get an easy job in Orillia while I get in better shape and apply to the OPP later this year or next year. I don't know where they'll put me, but I hope to eventually end up in Highway Safety. My first ticket was given to me the week after I got my G1 license (this street-cred will negate any and all future claims of me driving like someone's grandmother). An unmarked Impala got me doing 70 in a 50 on a two-lane road in Orangeville. Being a new driver, my parents convinced me to get a lawyer to reduce the charges and avoid demerit points. My next and last ticket was for doing 60 in a 50 - reduced from 72. Road conditions were bad and I pulled out from a somewhat blind corner just as a panel van was coming up the road. I gave too much gas and the tires broke loose, which alerted officers running a speed trap in the opposite direction. I also have two parking tickets; one was for, oddly enough, parking the wrong direction on a roadway. These three tickets were just paid without a fight. Ever since I finished high school, I have read the HTA at least once every year, so I tend to keep out of trouble. I have also added my own "set of rules" that I apply to my own driving, such as not passing on the right, using the left indicator instead of tailgating to indicate intention to pass, not trying to merge at less than the speed of traffic flow. Ever since discovering cruise control, I tend to set it at the limit and relax. I'm in Stratford once in a while, so I think I'll eventually end up on one of Bookm's videos with him getting more and more irritated as I fail to speed up. :D I have taught several friends to drive, but the recent focus on stunting has made it risky to do my parking lot understeer/oversteer recovery lessons. I joined up here because this site gives me a chance to see all sides of a case - the officer giving the ticket, the person receiving the ticket, and the lawyers who fight the ticket.

Improper signage

The :D , who have no real police work to do, gave me a speeding ticket. 65kph in a 50 kph. However the signs along Burlington street do not have the units. I heard of a precidence being set in Toronto once. This is a link to the law that says a sign has to have units either on the sign or below it. Anyone else ever try this or know about it. If this fails I'll try R. v. KENNEDY (1972) 7 CCC (2d) 42 The defense of necessity is available in strict liability offences such as speeding. I had to speed up and pass a certain collision event. http://www.canlii.org/eliisa/highlight. ... whole.html
