Re: Officer establishing traffic history re: Speeding
Interesting.... What if you can establish there is no way that an officer can have reasonably estimated speed or come to suspect speeding in the first place? Today I observed cars being pulled to the side for speeding as they were coming through an underpass.

Re: Officer establishing traffic history re: Speeding
I don't know how successful you will be going down that road. Lasers have scopes on them and the officer selects a specific vehicle (presumably one he suspects is speeding) aims the laser at and takes a reading. I would presume the scope can be used to extend the officers ability to see.

Re: Officer establishing traffic history re: Speeding
Perhaps you would get better help if you framed your questions a bit better. What exactly are you trying to get at?

Re: stop sign priority over scheduled no-turn sign
I would request a trial, and request the officer attend trial on the form. Online services such as fightmytickets.ca charges $12 to file this paperwork for you saving you a lot of time and hassle.

Re: stop sign priority over scheduled no-turn sign
A minor misspelling is no big deal. Do you want to fight this ticket or just get a reduced fine? Either way request a trial review the disclosure first, even if the case against you is solid the officer might not be at trial and you get off. If he's there you will more than likely be offered a reduced charge and fine in exchange for pleading guilty.

Re: HTA 78.1 (Distracted Driving)
As I already stated: requesting the trial gives you the benefit of reviewing the officers copy of the ticket via disclosure just to make sure the section is incorrect. To force the fatal error at this point is simple: do not show on your court date.

Re: Careless Driving Charge - Case Law Presentation
The prosecutor and JP will be well aware on what the standard of proof required to support a conviction. If the note simply said you had an isolated case of Vasavagul then it would be helpful to your case to present information on the condition and its sympthoms focusing on how it caused you to lose control of the motor vehicle you were driving ...

Re: Caught with a Suspended Driver's Licence for Unpaid Fine
Pay the outstanding ticket right away at the courthouse and the reinstatement fee for the license to get it back and then renew your sticker. Go to court on the day of your summons and ask for a deal on the 2 tickets you just received saying you completely forgot about the 1st ticket to renew the plates and apologize should be enough to get them to ...

Re: HTA 78.1 (Distracted Driving)
Yes, that would be a fatal error but you would have to force it. I'd request a trial to get the officer's copy of the ticket in the disclosure just to make sure. If it is for sure the wrong section then don't attend trial to force the fatal error.

This happens all the time. I don't see any professional misconduct here if you led her to believe that you have a drinking problem. The doctor was required by law to report you to the MTO, they review the information and make a decision. Some doctors will give you a heads up, others prefer not to risk a confrontation. I know what you are saying ...

The more rockets you have on your record the less likely you will be offered a 0 points deal, but that being said the more convictions caused by rockets (even 0 point ones) the less likely your friend will be insurable and that is tantamount to losing your license.

I would try getting it cancelled based on the fact that he has a permit even though he is sure the car was never there. The cancellation guidelines don't seem to address this but it's worth a try:

$300 insurance, and if an officer sees you commit 3 HTA infractions he cuts you a break on the spot to a bylaw infraction? Okay everyone, time to move to London!
I don't think I would not aggressively fight this ticket and I strongly believe you should aggressively fight every ticket. Weigh how little you pay for insurance and the ...

Re: Provincial/Federal Jurisdiction and Deputization
I have a feeling even if you can get the officer to admit that he was in Ontario observing cars (for expired plates or mechanical defects) that were in Ontario that had undoubtedly just crossed in from Quebec only seconds before, the prosecutor will still likely be able to prove that you committed an offence in Quebec because of the nature of ...
