Interesting.... What if you can establish there is no way that an officer can have reasonably estimated speed or come to suspect speeding in the first place? Today I observed cars being pulled to the side for speeding as they were coming through an underpass.

I don't know how successful you will be going down that road. Lasers have scopes on them and the officer selects a specific vehicle (presumably one he suspects is speeding) aims the laser at and takes a reading. I would presume the scope can be used to extend the officers ability to see.

I would request a trial, and request the officer attend trial on the form. Online services such as fightmytickets.ca charges $12 to file this paperwork for you saving you a lot of time and hassle.

A minor misspelling is no big deal. Do you want to fight this ticket or just get a reduced fine? Either way request a trial review the disclosure first, even if the case against you is solid the officer might not be at trial and you get off. If he's there you will more than likely be offered a reduced charge and fine in exchange for pleading guilty.

As I already stated: requesting the trial gives you the benefit of reviewing the officers copy of the ticket via disclosure just to make sure the section is incorrect. To force the fatal error at this point is simple: do not show on your court date.

Yes, that would be a fatal error but you would have to force it. I'd request a trial to get the officer's copy of the ticket in the disclosure just to make sure. If it is for sure the wrong section then don't attend trial to force the fatal error.

This happens all the time. I don't see any professional misconduct here if you led her to believe that you have a drinking problem. The doctor was required by law to report you to the MTO, they review the information and make a decision. Some doctors will give you a heads up, others prefer not to risk a confrontation. The more rockets you have on your record the less likely you will be offered a 0 points deal, but that being said the more convictions caused by rockets (even 0 point ones) the less likely your friend will be insurable and that is tantamount to losing your license.

I would try getting it cancelled based on the fact that he has a permit even though he is sure the car was never there. The cancellation guidelines don't seem to address this but it's worth a try:

1 & 2) Personally I think you should fight every ticket. Worst case scenario you are convicted which is the same as pleading guilty. Best case scenario you get off for any number of reasons. For all intensive purposes the only defense to this charge is to convince the JP that you were in fact wearing your seat belt (everything else is irrelevant).

In my personal experience most officers are pragmatic and will not ticket for less than 15 or under. Then again I've seen tickets 8 over. Almost all tickets that I have come across that are for 15 over were roadside reductions.

They can't find out from an abstract the original charge but keep in mind that conviction for 15 over the limit implies that you were given a break by the officer on the scene or worked out something with the prosecutor.
