If you seek early resolution, they might drop it to left turn not in safety. Personally, if you feel that you were driving properly, I'd hire a professional and try and win the case. You should have tried to bring up the 11b today you might have got the charges stayed then and there.

At this point I'd go to a good paralegal and have them file the 11b and make the arguments for you.

I think you are right but there are a lot of things you can get a ticket for without a sign being present. He should have given a ticket for driving on the shoulder.

It all comes down to credibility using 2 defenses that contradict each other make you look less credible. If you can establish that the officer could not have see your wheels when he said he could then the JP might find him less credible than you giving him reasonable doubt. You have to choose, either say you did stop or you didn't.

Personally I would not use the "could not see the sign from 60m" defense unless you can prove there is a an obstruction. The photo you have is weak. I watched a guy use this argument and it fell apart when the prosecutor asked him if he had ever driven through the neighborhood before he ...

I can't really see a successful argument being made in court: that since the officer made an error in transcribing accurately, they may have also erred in what led them to believing you committed an offense.

Thanks Simon. So basically does the law dictate that the JP cannot consider my point that the photo does not clearly show the exact position of the front of the vehicle in relation to the stop marker unless I can convince him/her to issue a summons to the of the officer who certified the offence occurred based on the photo?

Thanks for your input. The scanned image looks just like the one that was mailed to me. Will the JP allow the image to be altered by brightening to scrutinize the image.

I guess it boils down to if this image as is illustrates reasonable doubt.

Red Light Camera - unclear photo? faulty equipment?

I know this is essentially a glorified parking ticket but there are principles here. I'd really appreciate some input into this one.

Westbound Lakeshore at York under the Expressway at 3 PM though from the dark photo you would think it was 3 AM.

Even though in all photos the light is clearly red. It is my feeling that photo cannot prove guilt ...

Oh I gotcha. I asked for a court date in April 2010, got a notice of trial on March 30th in December, requested disclosure in January and received it 2 weeks later. So that would be all them. I really dont want to give them $110, they so don't deserve it. If they stay the charges I feel like asking for my lost wages, gas and parking....everyone ...

The delay can't be my fault if they ran out of time can it? First thing I said when they wanted to reschedule was that I objected to it and I wanted my trial today.
Are there any rules of thumb as to when an 11b stay becomes a sure thing?
Perhaps people would benifit if they knew chances at 12, 13, 14, 15, 16, 17 months and beyond? Does anyone keep ...
