I would try to argue that the term "confuse the identity" is subjective, and I feel the reasonableness test would apply. I don't know that you'll win but I'd take this to trial and put the officer on the stand and see if he could be credibly claim that he was confused by the identity of you plate. So you rear ended a car that braked, that in turn hit another car and you were doing 78 kph. Accident fault would be correct. The other driver going 20 kph below the maximum is irrelevant.

$380 per month with a clean record? That's high. It would make sense if you are under 25 with limited experience. Meeting with a prosecutor is only if you want to plead guilty to a reduced fine/points/charge. The meeting is not a trial and you will not be defending yourself there so don't bother with bringing pictures at this time. It will not effect your insurance or be on you or your wife's driving records. You can file for trial if you want and a deal for a reduced fine will be offered there at a later point in time.

Unknown offence fatal error? Maybe but I don't see the logic in this one. Maybe if you had 2 plates side by side on the rear of the vehicle would be enough to make the charge as written not make any sense...but that's not what happened.

It depends on how bad a boy you have been and what court house you are heading to. More serious charges tend get bumped up where you receive a summons to attend court on a specific date and set a date for future hearings/trial. I've been hearing from 4 to 12+ months depending on the officers schedule and the courthouse.

Trying to blame the car for being there for any reason is not going to fly especially if it was not moving. You are supposed to drive at such a speed where you would be able to detect what is ahead and respond accordingly. Just to get this straight the officer had you leave a parked car on the shoulder of the 401 express lanes for no other reason than to shuttle you to your exam? To my knowledge red light cameras will trip when the speed sensor embedded in the road detect you travelling at a speed where you will be unable to stop in time for the light at the stop marker. If you were skidding at a low speed it might not trip the camera.

I believe any claims are 6 years and HTA tickets are 3 years from the date of conviction. If your rates hold steady it would be about a $2000 premium increase per year for 3 years hit but if you factor in the lost discounts you would have gotten it could be significantly more.
