Re: Confuse plate identity. Please help! :(

I would try to argue that the term "confuse the identity" is subjective, and I feel the reasonableness test would apply. I don't know that you'll win but I'd take this to trial and put the officer on the stand and see if he could be credibly claim that he was confused by the identity of you plate. Make sure you have valid pictures to support where ...

Re: Charter violations by the Ontario government

What I don't understand after having read the document is how you get a "fair and public hearing, by an independent and impartial tribunal". How do you get a "public" hearing online?

Re: Has Anyone Been Charged With This?

So you rear ended a car that braked, that in turn hit another car and you were doing 78 kph. Accident fault would be correct. The other driver going 20 kph below the maximum is irrelevant.

Re: Please help find who's fault is this (dash cam video)

$380 per month with a clean record? That's high. It would make sense if you are under 25 with limited experience. I'd budget for a couple hundred extra dollars depending on your fault level and if you are eventually issued a ticket by the police even more. But in all honesty, having seen the way you drive I wouldn't be terribly shocked if they ...

Re: disobey stop sign - officer don't have a clear view

Meeting with a prosecutor is only if you want to plead guilty to a reduced fine/points/charge. The meeting is not a trial and you will not be defending yourself there so don't bother with bringing pictures at this time. If you want to go to trial ask for disclosure at the meeting and then ask for a trial date. Review the evidence against you and ...

Re: failing to wear seat belt

Meeting with a prosecutor is only if you want to plead guilty to a reduced fine/points/charge. If you want a clean abstract the only chance (unless you have a fatal error on your ticket) is to file for a trial, review the evidence against you and decide if from there what you should do. (if you admitted driving without a seat belt to the officer it ...

Re: Please help find who's fault is this (dash cam video)

Subsection 8 tells:

"When under this section a driver is permitted to proceed, he or she shall yield the right of way to traffic lawfully using an intersection or, where traffic control signals are erected where a private road or driveway meets a highway, lawfully using the area controlled by the traffic control signals."

Re: Sorry, another red light camera question

It will not effect your insurance or be on you or your wife's driving records. You can file for trial if you want and a deal for a reduced fine will be offered there at a later point in time.

You would be at fault. You did not wait for the intersection to clear before you proceeded with the green.

Re: Fail to Display Two Plates

Unknown offence fatal error? Maybe but I don't see the logic in this one. Maybe if you had 2 plates side by side on the rear of the vehicle would be enough to make the charge as written not make any sense...but that's not what happened.

Re: How long does it typically go to trial in Toronto?

It depends on how bad a boy you have been and what court house you are heading to. More serious charges tend get bumped up where you receive a summons to attend court on a specific date and set a date for future hearings/trial. I've been hearing from 4 to 12+ months depending on the officers schedule and the courthouse.

Generally don't bank on the ...

Re: Carged with careless after hitting a car parked on highw

Trying to blame the car for being there for any reason is not going to fly especially if it was not moving. You are supposed to drive at such a speed where you would be able to detect what is ahead and respond accordingly. If it is dark and your headlights do not give you enough visibility...you reduce speed.

You will likely be offered a ...

Re: 140km/h and was given 115km/h ticket

Just to get this straight the officer had you leave a parked car on the shoulder of the 401 express lanes for no other reason than to shuttle you to your exam? (I don't think I believe this story given the amount of danger you will be exposed to when you go pick up your car not to mention how unsafe it will be for other drivers.)

To answer your ...
