Re: Requirement to Open Window?
It would not work, there are no absolute rights in Canada. Random spot checks for impaired drivers would require you to open a window. An officer also has the power to check the mechanical fitness of your vehicle at any time and while doing so may require you to exit the vehicle. If it's any consolation you may keep your window shut all you want ...

Re: Roadside Trailer Seizure without impound order? + ticket
Sorry I forgot about the personal use exemption they came out with a few years back (living in the past I guess). Basically to qualify your vehicle should not have been modified in any significant way (if it's a pickup it must have the original box on it) and must not be engaging in most commercial activities. What I said is true but only if you ...

Re: Roadside Trailer Seizure without impound order? + ticket
I think you're lucky you didn't get buggered up with the CVOR issue.
If your truck and trailer are registered for or are actually over 4500 kg then a CVOR would be required. (There are a few exceptions but I don't believe you qualify)
If you are deemed to be commercial vehicle you could have been charged with the following in addition to what you ...

I don't see how a policy (real or not) requiring an officer identifying themselves has anything to do with charges related to the HTA.

Cosmic bliss....
You got a fatal error on a ticket quashed and now you were forced to pay a debt from a long time ago that has zero impact on your life.
I wish the Federal Government would deduct income tax refunds from all the people who owe me money.

Re: Failing to obey a stop sign - video recorded evidences
This is one you would want to take to court showing a different car in the video.... until it shows a car being driven by you not stopping. But if the video doesn't capture you not stopping but shows a car different from the one on the ticket being driven by you then you would have a tremendous edge during the trial. The officers error in failing ...

I'm going to go out on a limb here seeing how the cell phone law didn't exist when you were born I would try forcing the fatal error.
I don't know that it would be successful but given the kind of ticket you got you don't really have much to lose.
Any other thoughts on this one?

Congrats on beating the ticket. I'm guessing your accident was still deemed 100 percent your fault by the insurance, so I don't know you'll find affordable coverage for some time.

The officer will testify as to what is in his notes he's just a witness like you. You will challenge the officers credibility on cross examination and/or give your own conflicting testimony stating that you are absolutely certain you were not holding a phone. The prosecutor is the one who will challenge your version of events. If you are the more ...

I recall driving a farm tractor at that age, others may have driven a go-cart. The responsibility rests with the parents if she causes damage or injury. If she is on private property the posted speed limit and licensing/insurance requirements would not apply. If you feel she is driving dangerously approach a local police detachment and ask them to ...

The officer has 6 months to charge you.
Three things could happen:
1) Nothing (unlikely)
2) Officer comes to your home with a summons for speeding 68 over and stunt driving. I don't know that they will impound the car and retroactively suspend your license once they have already released it to you, it defeats the purpose of an immediate ...

The HTA charge against you is different and completely separate that the civil action commenced against you by the passenger. I wouldnt be suprised if they are suing both drivers especially if your passenger will corroborate that the other guy did not stop for a red.

How fast were you going? 50 over the limit? Or was the limit 50 and you were exceedit it by some amount?
Was it is the total fine?

Re: Being sued by my passenger
This is why people have insurance, so you shouldn't be worried if you have proper coverage. Yes you personally are being sued for your negligence but unless there is some sort of catastrophic injury (exceeding claim limits), criminal act or misrepresentation on your part your insurance policy will cover it. Don't take it personally...I've seen ...

Re: Can a cop re-instate a higher fine after issuing reduced
If this goes to trial and the officer's evidence is average, the prosecutor will ask for the charge to be amended to the actual speed. It is totally legit and the officer is right to tell you the odds of getting out of this ticket are stacked against him. Speeding is hard to beat and officers often give roadside reductions to save you the time of ...

If the officer testifies that you were facing a red light and the video camera shows you slowing to an almost stop and then turning is likely going to result in a guilty verdict. Just because it does not appear in the video does not mean it did not happen. Video evidence works in your favor where it clearly contradicts the officers testimony.

If it was a speeding ticket own it's possible you could attack the officers credibility with regards to speeding if the notes and audio showed inconsistency with the actual charge on the ticket. But even if this is true and the JP finds in your favour (you would have to have a really good cross examination and a VERY sympathetic JP) this still ...

I don't think your case is winnable as you cannot even use a due diligence defense. If there is a loose piece of cargo in the cargo area then you are carrying a load. If the cargo in the cargo area is not properly secured then you have yourself an insecure load. Failing to look into the cargo area before you drive is not an valid excuse. If you ...

, but, if you're feeling guilty for putting her in this situation then meeting with a prosecutor is the next best choice. They are going to offer to withdraw 2 to 3 charges in exchange for a guilty plea.

You basically admitted to the officer that you were driving carelessly. Continuing to drive while the sun was impeding your vision is tantamount to driving with your eyes closed. It will not make a difference on your licence record; you only get ONE and it lists the different types of vehicles you are allowed to operate.

Does anyone know if there is a hassle-free mechanism to withdraw the charge if the vehicle was part of a funeral procession? I was told by a family friend who was part of one that he and 8 other people that he knows of got RLC tickets.
