Re: FAILING TO STOP AT ALL WAY STOP

I'm assuming this is for a traffic control signal intersection, where one of two things happened.

1) HTA S.144 (21) Flashing red light — fail to stop
$110 fine + 3 demerit points

2) HTA S.135 (2) Fail to yield — uncontrolled intersection
$110 fine + 3 demerit points

What do you mean by officer's certification? Waterloo v. Yan has set the threshold for summoning the officer really high; the regulation doesn't require the disclosure of the officer's certification to secure a conviction. http://www.e-laws.gov.on.ca/html/regs/english/elaws_regs ...

You can pay the fine at any time, even at your trial date. Representation will not normally make the original charge worse, if you choose to proceed to trial and were given a roadside speed reduction; proceeding to trial will amend the charge back to the original speed.

Re: [URGENT/SERIOUS] Goin 185 KM/H on Highway (100 Limit)

I'm pretty sure the vast majority of drivers around the world could travel at 185 km/h in a straight line; i don't think they consider themselves as elite drivers, all that's required is one arm, one leg and a brain-cell.

The problem with going 185 on a public road and especially in an Ontario plated vehicle is that neither are designed for it ...

You will most likely get knocked down to the 3 demerit point bracket (+16km/hr to +30km/hr).

Every Insurance company is different: speeding can be categorize as minor, major or serious. The IBC brochure has an example http://www.ibc.ca/en/car_insurance/documents/brochure/faq_on%20brochure_eng.pdf

If you receive disclosure at trial or very close to the trial date; you can request an adjournment and ask for more time to review the disclosure.

The remedy for 'non-disclosure' is simple, you get disclosure. It appears the crown has satisfied their disclosure obligations?

Date you received 'notice of trial'

Re: 182(2) for "no right turn on red" ? is by-Law needed? HE

Insurance companies can only increase your premiums based on HTA, CAIA & Criminal Code convictions. They can not increase your rates for by-law infractions, it most likely won't even show on your abstract; this again stresses the message that they don't care about demerit points whatsoever.

Points will stay on your record for two years from the ...

You have to exercise due diligence with your disclosure requests; it's in your best interest to request again for explanations for the short-form writing.

What municipal by-law do you think is applicable with your charges? You will most likely have two out of the three HTA charges dropped in exchange for a guilty-plea on one of them.

You should request disclosure and see the officer's notes. With three tickets, make sure there are no 'fatal errors' on any of them: http://www.ontariohighwaytrafficact ...

It's your responsibility to contact the court house to monitor the status of your ticket. I don't believe they're lawfully obligated to let you know whether it's quashed by mail.

If you're convicted, they may send you a letter with a 'Notice of Fine and Due Date'. If you fail to pay, you'll receive a letter from the MTO that your driver's license ...
