Re: Refund on towing fee related to dismissed parking ticket

Some private property locations have different enforcement protocols: ticket everyone, tow everyone, tow on repeated offence, never tow. Unfortunately, this seems like rotten luck for you.

We had a similar situation, where a resident from a condo parked in their designated spot. Unfortunately their vehicle wasn't registered in the private security ...

Re: Disability Parked Car got ticket despite having Permit.

Was any part of the car touching or on-top of the hashed lines? Usually handicap spaces, have hashed lines around them and they're designated access aisles for pedestrian traffic. They're used mainly by disabled drivers/passengers to get in and out of their vehicle with ample space. You can't park or obstruct these hashed lines. The set fine is ...

Re: First Offence - 85km/h in 60 zone

If your intention is to plea-bargain at your trial date, you should file both tickets for trial. The prosecutor will most likely drop the 'registration ticket' in exchange for a plea-deal on a reduced speed (most likely +15km/h: no points).

Once you get your 'Notice of Trial', you should request disclosure from the prosecutor's office. You can ...

There is no guarantee the ticket will get waived; the 'Fail to Surrender Insurance Card' ticket is not for driving without insurance, it's for not producing an insurance card promptly to a police officer when requested.

Re: Can a google earth satellite image be used in trial?

The #1 problem with Google Maps, Earth & Streetview images is that the pictures were taken a long time ago. The intersection you received the offence notice may look different.

Google Earth images can be years old.

I read a decision on CanLII with a driver who received a ticket on the 407ETR for driving by a police vehicle with emergency lights ...

It's all public information, you can request for it through city hall.

What department should I ask? Is it free? Do they get you a copy immediately? Do you need to fill out a Freedom of Information Request Form?

Thank you iFly55! Even if you call 311, they'll re-direct you to the appropriate department. It's free, they'll most likely send it to ...

Re: 90 in 70 zone reduced to 80-fight or not

Also submitted the city road map report with the roads categories and speed limits and it was totally ignored by the Justice(what a joke). The road was listed as category B and speed limit 80 outside urban area-the Justice accepted the prosecutions statement that in the city speed limit is 50km/h just by saying so.

Where did you get the city ...

To secure a conviction, the crown must establish the essential elements of your charge.

Regulation 615 requires that the sign be visible at a distance of at least 60 metres: http://www.e-laws.gov.on.ca/html/regs/english/elaws_regs_900615_e.htm

Sign must have been erected after Sep 2012, because I can't see it on Streetview: http://goo.gl/3oiYsn ...

Re: Fighting a 97 in a 60 with "Legal Justification"

I would like to fight this ticket and get the charges completely dropped because what the cop hadn't seen was that i had just accelerated to avoid an accident with another car. I have written an account of what happened which i plan to present to the court along with snapshots from google images to back up the account. Don't bother with Google ...

Re: Wrong posted speed written on ticket

It doesn't matter what path you choose

1) ignore the ticket
2) option 2 - early resolution
3) option 3 - trial date

All three paths have the same conclusion if you don't appear; a justice of peace will have to review the face of the ticket and quash it if there is a fatal error.

Re: do police officers ever get tickets themselves?

Most police officers follow the rules of the road whether they're in a marked cruiser or a civilian car. They set the example for everyone else on the road. Having said that an officer could lose his job if he was caught driving recklessly. To even join the force you need a clean driving record, not sure why they would ruin it by speeding, running ...

Re: Letter informing vehicle owner that car was seen speedin

It could be a roadwatch letter, and some jurisdictions outline how consecutive complaints could result in an officer detailed to follow you and monitor your driving.

Lets say you were stopped down the road for speeding, can the officer see previous roadwatch letters for that the vehicle's plate/owner by the side of the road? Is roadwatch ...
