Court date but no notice of disclosure

Unread post by jamz879 »

Hi there,

I sent in 2 requests for a notice of disclosure - 1 by mail and 1 by fax (have the fax confirmation). I received a trial date for September but no notice of disclosure yet.

Should I send in another request?

Thanks.

When did you send in your requests?

Re: Court date but no notice of disclosure

Ontario Prosecutors require 6-8 weeks to process disclosure requests.

I sent it beginning May. The offence occurred in April.

Will it affect the process if I send another one just to be sure?

And I guess my follow-up question is if I don't receive one in time, what should I do?

Re: Court date but no notice of disclosure

Go to court, explain that you still haven't received disclosure yet, and show proof that you did, in fact, make a disclosure request.

The JP should grant an adjournment so you can get disclosure.

Are they picky with the proof? I mean I have the fax confirmations with the date, number sent to, etc. It's my first time going through the process so not sure what to expect.

Thanks for the help.

Somewhat. But if you have the fax confirmations that should (not necessarily will) be enough.

Ok thanks. I'll post an update after the court date
