Re: licensed in another province at time of suspension

Once you have a licence in Ontario in remains for life. You can turn the licence in, but all details on MTO remain intact. Unpaid fines still remain against the Ontario licence until paid. So your licence would have said 2 things on it when the officer checked: expired licence and suspended. A driver has 6 days to notify the MTO of a change of ...

You could check your own muffler thou. Look at tip of it, if there is a bolt hole in the edge near the tip, the baffle has been removed. Just order a new baffle and bolt it in for driving on the road. If you need it out for car ...

Points are administered ONLY by the MTO upon a conviction. Has nothing to do with police or courts.

3 points has probably been in affect since the Demerit Point Regulation 339/94 = 1994

Anyway, this is a CRIMINAL CODE offence and is not suitable for this forum. Seek a forum that supports criminal offences and/or contact a lawyer.

Re: Careless Driving - with 3-Day Suspension alcohol warning

You only have one offence which is the "careless driving".

The 3 day warn is not a charge. It is an administrative drivers licence suspension for 3 full days from the time of the stop. That is why your vehicle was towed from the highway.

Yes, the defendant should say exactly what happened: "Crown attempted to give me disclosure this morning." No argument there.

Respectfully, though, I'd say that the defendant needs to make a case that the adjournment was caused by the Crown, not him. .

Yes. Disclosure, motions, etc., are preliminary matters and must be dealt with before the trial starts. Show up early, check in with the Prosecutor. Do NOT accept the disclosure package if they have it and want to give it to you before trial. Tell them that you are going to have to speak to the JP first.
