(3) Every person who is at least 16 years old and is a passenger in a motor vehicle on a highway shall,
(a) occupy a seating position for which a seat belt assembly has been provided; and
(b) wear the complete seat belt assembly

Seems kinda unfair considering I wasn't told where I was dinged and that the only information they had was that my car was 'red'. There were lots of speeding red cars!

Just easy enough to look in the NB Traffic Act (or whatever it is called there) and see if there is a Provincial Suspension imposed.

Ontario automatically imposes a "provincial" suspension - can not be altered/changed/deleted by any court.

There are 2 types of suspensions you are dealing with, each having their own meaning.

1) Criminal code suspension of your driving priviledge, commonly knows as a "prohibition order", typically prevents you from operating anything with a motor(car, boat, golf cart, riding lawn mower etc..) for a set time period and is "Canada" wide and anywhere ...

Hwybear, how would you charge for TC violations? I see in some other provinces that their MVA/HTA has a section stating that all vehicles are to meet TC requirements or at least CMVSS. Nothing like that under the Ontario HTA that I can find. Would the ticket directly reference the TC standards document?

I don't know how to charge under TC ...

As per Transport Canada - which over rides HTA for vehicle requirements
- headlamp must have an "upper and a lower beam" and be located on each side of the vehicle as possible plus be greater than 559mm (22") and less than 1372mm (54") from the road surface

Add to Stanton - even the daytime running lights (which is high beams operating on a tiny amount of power) do NOT meet requirements of a headlight as they do not have enough power to illuminate the surface of the road.

and why would anyone "not" want to see or "be seen" at night is simply baffling

If it is not marked as you indicate, there is 2 speed limits of:
- 50km/hr in a built up area (inside city limits)
- 80km/hr in non-built up area (rural)

Secondly, the notice to show from the province indicates that on the alleged offence date I was pulled over at 3:10 pm. I was 40 km away at that time doing a job I can verify with witness. The actual time was 1:10 pm. Not sure what the actual ticket said, since its mailed in now. I'm thinking some clerk looked at 13:10 as 3:10pm by mistake. Does ...

There are loads of time variables that are not accounted for in the calculation you are doing from the receipt.
- printing receipt
- clerk handing to you
- walking to vehicle
- getting in vehicle
- setting wallet/purse down, taking off jacket, setting drink down
- putting on seatbelt
- starting vehicle
- starting to get mobile, getting to edge of ...

If the left-turn arrow facing me isn't on, I'm safe to make a right-hand turn, as you (Stanton) said. The complete lack of logic in that really just boggles the mind..

I believe the logic is that most times (not all) when the left arrow is on, the traffic on the opposite side also has a left turn arrow. Those approaching vehicles turn left ...

Unless something has changed at nine demerit points a sixty day suspension for a G1,G2,M1,M2 driver. Also there is no points for a 50 over. You have a suspension for the offence.

HTA OREG 340/94 sec 9(3)(3) Novice driver will be suspended for 30 days for an offence ...

IMO = terrible decision if you read that case.

So in other words everyone can drive anywhere, blastin down ramps (passing many motorists in the normal lanes) then wait until very last minute of the ramp and then swing across the "bull-nose" and back into line.

Nobody will be able to say for certain (different court areas have different procedures for asking for a trial)....read the directions carefully on the back of the offence notice and act accordingly.

There is no requirement the officer has to pull you over immediately after the offence, they could stop you the next day if they want. Some reasons for delays in stops are to get information back on the plate or to have the vehicle stop on a safer stretch of road.

Imagine that :idea: ....waiting for air time...then to check the plate and then ...

I was driving on a rural road at night in an 80 kmh zone. I was driving up a hill. At the top of the hill is a 90 degree turn sign (no stop sign, no kmh posted). I hit the brakes too late, and because the road goes downhill and there's a lot of gravel, .

Just re-read start of post and doesn't make sense > rural road ..up a hill...with 90 degree ...

With everything above spoke of above it is more than just a momentary lapse or simple error. It appears to be mulitple simple errors in judgement compounded.

I lived on a gravel road for over 10 years. If it is fresh gravel (just put on road and graded) it is very recognizable by colour, feel of vehicle and sound (tires on it). Gravel roads on ...
