That is not a Highway Traffic Act case. It's a negligence case between two families and the insurance company involving multiple factors. Along with an obstructed view, the occupants were drunk and the car was travelling 100km in a 50km zone.
... Even with his knowledge of the intersection he had no reason or obligation to anticipate that a car ...

Re: Left turn not in safety charge after an accident.
You can take anything to trial. If you're asking whether or not you're at fault, you are. What you've described is not a defense.
This is a common situation for accidents.
Since you're turning, the onus is on you to do so safely. It's not up to the "impatient" driver with the right of way to adjust their driving to accommodate a turning vehicle ...

Re: Traffic laws when in public school parking lots
These are not necessarily Highway Traffic Act issues.
While on any Ontario highway, an officer can stop you and ask for license, insurance, and permit any time they want.
A school parking lot in practically every case will be considered private property. What that means is the Highway Traffic Act doesn't apply. However, that doesn't mean private ...

If this is something you'd like to take to trial, you can do so by selecting the appropriate option on the back and attending the courthouse. They'll give you a simple single sheet form to fill out (Notice of Intention to Appear). You can even download it online , fill it out, and submit it then and there to save you a couple minutes.

Re: Careless driving charge for rear ending someone
You are responsible for the vehicles ahead of you. You will be at fault almost every single time. Even those instances that you wouldn't be, they are almost impossible to prove.
However, this isn't one of those instances. You keep talking about scanning the left lanes of traffic, not the signal. I'm going to guess there is no advance right turn ...

Re: June 18 Careless Driving Trial - Still no Disclosure Received
First, I've read that I could effectively win the case on a technicality if by the date of the trial I have not received disclosure, is this true?
No, because more than likely, you'll receive your disclosure package the day of your trial. They'll probably give you a new date and you'll have to go through the hassle of showing up again. You can ...

You're at fault for the accident. You had the stop, the other driver didn't. You pulled in front of them. I get it. Almost no one who has an accident wants to admit fault. However, your defense isn't a defense. Just because you've come to the conclusion that there is a speeding problem on that street doesn't prove anything. If I live in a ...

If you missed your court date, you would have been convicted. You'll have to ask that the trial be reopened. I believe you have something like 15 days to do so.
This could open a whole can of worms with the MTO. You should probably keep tabs on your license and its status. There's a possibility that it could be suspended at any time.

Re: Summons issued 5 days after alleged offence? Is this legal?
An officer has 6 months to lay a charge.
Sure, pulling over the vehicle is more common, but I don't see why it wouldn't be enough for a possible conviction if the officer could identify the individual behind the wheel.

Re: Red Light Camera Warning Signage Legislation?
I'm sure there is legislation that states a red light camera must have a warning sign prior to it, as every red light camera has one, and I've seen a news article reference said legislation, however they were not specific enough. Have checked the HTA, found nothing on the subject, didn't expect to find anything in there.
There is no legal ...

They have 7 days to file the ticket.
They have 6 months from the date of offense to charge you. If they want, they can just rewrite another ticket, give it to you, and file that.
However, the chances of them further pursuing a 15km over ticket is usually slim. In Northern Ontario though, who knows.

These are the new rules they made to coincide with the legalization of cannabis. They are basically the laws for alcohol, except for cannabis. You should be transporting your weed exactly like alcohol because the rules are pretty identical.

Re: I was involved in a major accident and i don't know if I will be charged or not.
Agreed. If you have an advance green and witnesses can verify that, then I wouldn't expect anything to come from this.
If you have a green and are waiting in the intersection to make a left, the light turns red, you proceed to complete your turn, and someone tries to squeeze through the signals, then it can be a whole can of worms where you can be ...
