Re: Driving with Handheld Device ticket (Cellphone) - Need Advice HTA 78.1

I am extremely worried my insurance premium will double...what should I do?

While the province has taken a hard stance on distracted driving, auto insurance companies have always been slow to catch up on this one. I believe they still consider this one a minor offense even after the new handheld fines. Realistically, it would be treated much ...

Re: Advice needed - Disobey Sign (Illegal U-turn)

They are paid to show up just like any other part of their job. It's not a normal occurrence for an officer to miss out on a court date. They might not be waiting in the courtroom when you arrive, but they'll show up. They also book court dates at their convenience, meaning you probably wont be the only person there dealing with this officer.

Re: Advice needed - Disobey Sign (Illegal U-turn)

The spelling mistakes wont matter. The notes are to refresh the officers memory. They are not going to trigger some fatal flaw. Example, practically every set of officers notes will contain abbreviations and those are fine. If you need clarification, you can make that request. However, the trial will keep on rolling.

As for the video, consider you ...

You're likely not going to find anyone easily who will prepare for a full blown trial on a minor speeding ticket.

If you're trying to get some more months out of this, just book a trial. You're likely not going to get a date within the next 6 months at the very least depending where the courthouse is.

Handheld device conviction absolutely can impact your insurance.

Re: effects of sleep disorder on DL and INS, went to a sleep clinic

There are a list of conditions that a doctor is required to report to the Ministry of Transportation. These are conditions that could suddenly impact a driver while driving (eg. heart conditions, black outs, strokes, alcohol dependencies, ALS, MS, brain issues, etc). I believe sleep apnea is one of those conditions.

If that's the case, the doctor ...

Re: Any advice on hand held device while in gridlock traffic?

The fact they told you to represent yourself says a lot. They aren't wrong either.

From their prospective, it's a losing situation for them. At the very least, they can't even get you a reduced charge. It's either you're convicted of the handheld charge or not. Their bread and butter is speeding tickets. You get charged with 40km over, they walk ...

My question is, will this show up on my driver's abstract for my insurance company when it's time to renew?

Nope. That is the charge they give someone when they have a plate number but no idea who is driving the vehicle. The ticket then goes to the owner of the plate, like a parking ticket does. When you don't pay, you can't renew your plate ...

If you want the answers to your questions, you're going to have to request a trial. From there you can make a disclosure request and receive a copy of the officers notes.

If you need further information on how to make a disclosure request, feel free to reply with the courthouse listed on your ticket.

Re: What can I expect for charges of stunt driving

It's not uncommon that they offer a deal, but you should probably prepare for the possibility that they wont. Factors like speed and previous driving history will also come into play. Obviously, the closer to 50 over increases your chances. At 170, you're pushing your luck.

The 7 day suspension you received is what they call an administrative ...

Re: STUNT DRIVING CHARGE. Going at 153km on a highway! HELP!!!!!

Any ideas on how we could fight this case?

This is one of those charges where you hope to get a favorable plea deal. With a speed of 53 and a somewhat clean record, it's not uncommon for people to be offered speeding 49km over. It's the difference between a 5% surcharge on your insurance versus 100%. At the end of the day, the difference in ...

Re: Improper vehicle description on disclosure and improper signage?

There is no requirement under the Highway Traffic Act for speed ahead signs.

An officers notes will not contain fatal flaws.

They may contain mistakes, but it's up to you to point them out and make them relevant during a trial.

Notes are just there to refresh an officers memory, so do not put all your eggs in this one basket.

Re: Two tickets for same offence of expired sticker?

The wording changed in the last couple years on permit validation. It leaves it up to interpretation on whether or not affixing a sticker to the back of the permit is a requirement or just a suggestion.

However, you probably don't need to go down that rabbit hole. If you request an early resolution, they probably wouldn't pursue both charges ...

I don't know if it's all that obscure.

It's no parking 8:30pm to 4:30pm (Monday to Friday) except during July and August, where you are free to park.

It's most likely beside a school where there is a runoff from available spots in the parking lots or where students pay for parking.

You'd probably want to request an early resolution meeting (if available). Show them you have the required documents on hand. They might decide to let it slide.

Yes, failure to provide your license, insurance, or vehicle permit on demand will impact your insurance rates.

Luckily, Mississauga is probably the easiest place to make a disclosure request if you have no clue how to go about doing so.

You don't give up your option for a trial if you request an early resolution. If both parties don't come to an agreement, they'll simply book you a trial date for the future and you'll go from there.

Like ynotp said, careless driving is the worst of the worst when it comes to insurance. It's so bad that you should probably consider accepting ...

If you plan on fighting your tickets, you can start by requesting a court date. The instructions will be listed on the back of your ticket.

You'll wait for your Notice of Trial and then you can make a disclosure request. This will contain the evidence against you (usually just the officers notes, maybe video in some cases).

If you don't know how ...

Unfortunately, you can't argue your right to a trial to a speedy trial when you're the one postponing it. That ship has already sailed.

You also probably shouldn't wait until your trial to ask for another date yet again. They expect you to be ready to go. They might not take too kindly to the request the second time around.

You're in an awkward position because you were charged with two different offenses.

For now, let's just ignore whatever your defense may or may not be.

You're in an all or nothing situation. Let's say you have a valid argument and you successfully defend against one ticket. They are just going to ding you on the license.

Again, it's private property. It's not a HTA issue whether or not a specific track allows nitrous. That's up to whomever is sanctioning the event.
