The Crown can only amend the ticket at your actual trial. You can still safely request a trial and attempt to delay the matter without worry.
At trial, is there anyway to get the speeding charge changed to a non-moving violation (which wouldn't kill my insurance)?
FYI insurance companies look at all convictions, even things like expired plates ...

Tickets used to be standardized across the Province, but now the options vary somewhat between jurisdictions. Read over the options carefully to ensure youre selecting the right one.

There would be no automatic suspension, but your total demerit points would still be problematic. Once you reach 6 points in total, youre required to attend a meeting with the Ministry and explain why you should keep your licence. A suspension is still quite likely.

Out of curiosity, what is it that youd hope to capture on camera while at an inspection station? I get that while youre driving around a dash cam might be nice to show whos at fault in an accident, etc., but I though inspection stations were more about making sure paper works in order, vehicle is mechanically fit, etc.

45 over the limit would actually be a 4 demerit point offence. If you're convicted of any 4 point offence as a G2, it's an automatic 30 day suspension. Not sure if getting your full G before conviction nullifies the penalty or not.

The best place to start is by requesting disclosure. Obviously your version of events does not support a charge of careless driving, so youll need to see what the officers allegations are. Id agree theres no point in accepting a plea to a lesser charge at this time until you know more. Select option 3 and get full disclosure.

What charge/section were you ticketed with?
There are some charges that are based on not meeting certain legal standards, others that are more just the opinion of the officer.
I'd argue the ones that are based on opinion more then hard and fast rules can be easier to beat in Court. And I wouldn't say Harley's can drive around without punishment ...

You should be able to pick up your vehicle right away. Either have a licenced driver attend the tow yard with you, or make arrangements to tow it back to your property.
Just FYI, you may need to attend the police station first to get a release slip for your vehicle.

The driver can't be charged for operating a motor vehicle without insurance unless they're also the owner of the vehicle. In the OP's case, only she could be charged, not her boyfriend.

Demerit points are never shown on the ticket. The offence of follow too closely carries 4 demerit points.
Your copy of the ticket should say "offence notice" near the top and explain your three options on the back whereas the officer's original copy will say "certificate of offence" near the top.

This was all due to a lack of communication and perhaps he can just plead guilty to driving without a lisence and get some kind of a plea bargain deal or a lesser charge?

Id agree with Bend and say the chances of you getting any further reduction are slim to nil. The Crown will be well aware that the officer already gave you a break in terms of the stunt driving charge and associated suspension and vehicle impoundment.
In terms of amending the speed, that would be at the start of trial.

There's no specific "how to", it would be the same as any other charge. I'd suggest seeking a pre-trial resolution meeting with the Crown. Hopefully it would be a relatively quick process and they would just withdraw the charge.

You're correct, the bus must be stopped. If you can show (or raise reasonable doubt) that the bus was still moving, you would not be convicted.

No. At best the HTA could be considered quasi-criminal. It bears some similarities to Criminal law, but as said above it's Provincial law.

It may be worth hiring (or at least consulting) with a paralegal to review your case. Perhaps theres something they can fight the charges on in Court. Id also suggest speaking with the Crown prior to trial and seeing if theyre willing to offer you a plea deal. If all three charges are being dealt with together, perhaps theyd be willing to drop one ...

Insurance companies determine fault based on the fault determination rules here: http://www.ibc.ca/en/car_insurance/docu ... -rules.pdf
Even if the other driver had been charged with an offence under the HTA, under fault determination rules when you strike someone from behind you're 100% at fault.

The law requires you turn into the closest lane even if you must merge further up the road. You also must obviously stop at red lights even when road conditions are poor. Youre simply expected to adjust your driving accordingly. The Crown must prove their case if you go to trial, but it doesn't sound like you have a very strong defence based on ...

I dont believe you can get the record removed, since technically you were under suspension at the time. 1) No, the Ministry does not notify employers when a persons licence is under suspension. Its very unlikely the Ministry would even know who your employer is.
2) Possibly, although charges are more common once the notice has been sent/served.
Some additional thoughts. I know its very unlikely youll get pulled over while operating an armored car ...

The cameras only activate for red light offences, not amber. The cameras also take photos of your back plate, so if you were facing the camera it would have tripped for a vehicle travelling in the opposite direction.
