-Could I request a First Attendance without requesting a trial/court date?
Check the back of your ticket. Some will have an option for an early resolution meeting, some don't. If not, request a trial and then ask at the Courts about an early resolution meeting. Even if you request a trial, you don't have to go through with it. You can either work ...

Re: [HELP] First Ticket- 130km/h on Highway 401- Confusion!!
I now play a game of sticking EXACTLY to the speed limit when I drive- hilarious when I go 30km/h on the on-ramps with traffic behind me
The yellow speed limit signs you see for on/off ramps are the suggested maximum speed, not the actual limit. They're a safe speed for a fully loaded transport truck that might tip, not your everyday passenger ...

Re: Parking lots
The HTA states that youre required to have a licence when driving on a highway. Based on HTA definitions, a mall parking lot would not meet this definition, therefor no licence is required. However, the mall lot is private property. The mall, if they wish, can insist that anyone operating a motor vehicle on their property do so with a licence. You ...

The majority of times bylaw offences will not appear on your abstract and won't impact your insurance. The only exception I'm aware of are bylaws relating to prohibited turns at intersections.

You'd have to confirm what exactly you were pleading guilty to. If it was a local bylaw, it likely wouldn't appear on your driving abstract and wouldn't impact your insurance. If it's simply another HTA offence, then it will appear on your abstract and likely will impact your insurance.

Re: Desperate! PLEASE help!! Trial in 17 days!
It's difficult to say based on Google street view alone, but I don't think the southbound stop sign is properly placed. It appears that it's actually in the intersection, when in fact it should be placed before the intersection. It's still quite visible and likely fully legal due to the double driveway making proper placement impracticable, but ...

The photo you posted doesnt show the intersection very clearly, but I can see a sidewalk meeting the road for oncoming traffic. Oncoming cars would be required to stop there. Can you tell us what the intersection is so we can see it in Street View?

While not 100% accurate, most GPS units give real time speed information. Many highways also have mile (or kilometer) markers, so you could time yourself between markers and see if it matches your indicated speed.

The FSCO released a bulletin in 2006 stating insurers aren't to use administrative suspensions to calculate risk, since there's no conviction associated with it. In short, your provider should not be able to increase your rates.

Basically just remember first come, first serve. The first vehicle to a stop at the stop sign has right of way over other vehicles at the stop sign. Doesnt matter if youre proceeding straight through or turning.

Typically left turning vehicles must yield to through traffic, but stop signs work a little bit differently. Heres the section covering stop signs and right of way from the Highway Traffic Act:
Stop at through highway
136. (1) Every driver or street car operator approaching a stop sign at an intersection,

Was the charge you plead to under the Highway Traffic Act or a local bylaw? Theres a charge for parking on the highway under section 170 of the H.T.A., but theres also typically bylaws that would cover the same offence.

Speed limit signs are covered by regulation 615 of the Highway Traffic Act here: http://www.canlii.org/en/on/laws/regu/rro-1990-reg-615/latest/rro-1990-reg-615.html
I don't believe there is any requirement to post a warning regarding speed limit changes. There simply needs to be a posted sign advising of the new speed with "begins" below it.

I agree that most drivers speed up ahead of time, but that that isnt a valid defence in Court. If you said that in Court, youd be convicted. In terms of fighting the charge, its probably best you read through the forums and get some ideas on general strategies for fighting tickets. Its always a good starting point to request disclosure and see what ...

No, that specific argument would not be a valid defence in Court. Legally, youre required to obey the 50 km/hr limit until you enter the 80 km/hr zone.

The online fine payment system may be somewhat automated, where a clerk just types in the speed and the computer figures out the correct fine.

Any conviction for which you were charged as the driver should show on your abstract, not just those with demerit points. Again, if you go to trial the error can be corrected. Probably your best approach would be to force a fatal error based on the incorrect fine.

My fine sheet says it would be $359, which I think is correct. I'm wondering if they made a misprint in a batch of notebook companions.Decatur wrote:2) Just looked in the notebook comanion and the set fine for 49 over is $249 and the total payable is $355.
Base fine is $294, victim surcharge is $60 and court costs would be $5.
