Re: INSECURE LOAD TICKET - ANY IDEAS?
Thanks hwybear , I did look up the relevant section of the HTA.
Thanks Reflections . Nothing fell off the trailer, and as far as I'm concerned it did not look like it might. I was travelling about 20 kph with my 4-way flashers on just so that any bouncing from bumps in the road were minimal, on a stretch of Yonge Street in Richmond Hill around 12 ...

Re: INSECURE LOAD TICKET - ANY IDEAS?
Got a ticket yesterday for "Insecure Load" contrary to HTA Sec 111(2). $160. I was pulling a utility trailer in which I had loaded a steel and wood cabinet. Total length of cabinet is 57.5". 14.75" (1/4 of the cabinet) was sticking out over the side of the trailer at about a 45 degree angle, the rest (3/4) was inside the trailer. The trailer has ...

I thought that the "offense" would be criminal, not just OHTA related? Just my take on "offense".Proper1 wrote:I remember reading about one of these cases that had actually made it to court. The defense argued, successfully, that the accused was attempting to prevent the commission of an offense.

Re: Disclosure request content
Why not give them a time limit and say you will be down in person to pick it up on a specific date !
Or ask how long it takes ...if they say 5 days... then say you will be down on that date five days from now !
Or give them a time limit ( in writing by recorded mail ) slightly in excess of the time they say they need to get disclosure ready. If ...

Re: Disclosure request content
I haven't gotten any response yet and it's past my diary date. I'm planning on sending in another disclosure request.
Is there anything different I have to add from my first request? ie. telling them i haven't received anything or any response from my first request. this is my second request...
thanks!
Nope, two "recordable" request is plenty ...

Re: 33 over in an 80 zone
I recently received my first ticket in over 20 years of driving. I turned onto the highway at the intersection near my home and within less than 1 km, an officer facing me from quite a distance away signalled me to pull over. I did and received the ticket.
This highway is very hard to get onto at our intersection due to excessively high speed ...

Unfortunately you can't really argue on the road side. You'll have to explain the situation in court.

Re: red light camera offence ticket
I just wanted to let everyone know what happened at my trial - I approached the prosecutor individually before and I explained to him that the ticket was invalid, brought in a copy of Canlii, but he said according to Sec 90 of the POA, any problem with the ticket itself has no bearing on the finding of guilt. I persisted a little, so he told me to ...

There is nothing illegal about flashing people to warn them about radar traps. This happened to Brad Diamond of Motoring on TSN, Jim Kenzie wrote about it. The officer was just trying to scare you.

Re: Going 50km over in an 80
People are also saying when I go to my court date, if convicted, they could still impound the car. Is this true? Because I haven't read it anywhere else, nor did the officer say they were planning on doing so, although they aren't obligated to.
If your car was going to be impounded it would have happened road side. What's going to happen though ...
