Re: False Seatbelt Accusation
You will have to go to court and argue it. Was it day or night? You already mentioned lack of quick movements...mention your size and colours of vehicle, your clothing, interior of the car and the picture would help. Try to include a meter stick for comparison. All you have to prove is reasonable doubt to the judge, not the officer. Ask the officer ...

Re: Careless driving as well as parking, standing signs
The "permit" in question is your license plate. So, unless you can prove someone else parked the car there and you majically found it.....
I do hear you on the "pay enough already" part though.

Re: Careless driving as well as parking, standing signs
I just got a parking ticket yesterday. Was always wondering what happens if u claim u never got it on your windshield, which means you have never been served which means you cannot be convicted...but something tells me that doesn't apply to parking tickets otherwise everyone would claim they never got them))) Anyone has any knowledge on that ...

Welcome, Mr Bear, I see your signature changed.
As for me, I just have an interest in law for the every guy. I am not a lawyer but I can certainly help point people in the right direction.

Re: Improper Left turn on oneway street
It may be different for each Prosecutor. I know the last one I dealt with definitely WOULD use anything I said against me (if it went to trial). I asked and he told me so.

If your colour scheme was an option it would be available from the ministry. Look on the ministry website. They control the issuing of plates.

Re: Careless driving as well as parking, standing signs
I've got 2 questions and would really appreciate any feedback on this.
First.
In November 2007 after about 24 hours of no sleep I was driving on my way home, about 2 blocks away from home when I closed my eyes since I was very tired, I opened them when I was about half a second from hitting a car which was standing on the red light.

Re: Tailgating, We've all Done it.
Yes you can pass on a solid or double-solid line in Ontario (don't do it in the States though!). There are limitations though regarding minimum distances to intersections and railway crossings (don't know the specs though)
Think to your self, how far can I see. If you can safely complete the pass on the roadway you can see, there really is no ...

Re: Following too closely offence
If you can't stop in time, you were following too close for the conditions. I would rather get home 5 minutes later then sit and argue about this in the cold.Bookm wrote:This is why following distances are to be adjusted according to conditions. The charge was appropriate. I've been hit from the rear 3 times so it is a pet-peeve of mine.

Re: Penalties for speeding
Noone ever let me go without a ticket. The best they can do is lower the speed that they caught you with. Once they stopped me, gave me the ticket and to a person who was travelling beside me even though the officer told me he only measured my speed. I mean what proof is there that the car beside me had the same speed??? It just assumed it. No ...

Re: Penalties for speeding
And that's the way it should be. But this is Ontario where the courts hold the police to a very high standard. Is there potential for abuse? Hell ya. I proposed the use of cameras (as you have described) to Sgt. Cam Woolley. He just shrugged it off.
Me thinks they would find too many inconsistantcies with application of law.

Re: new car impound law
What can you say, our government is making easy money by targeting good drivers. Too bad that the we can't do anything about it. I'm actually sick and tired of all these new laws that really have nothing to do with safety.
Thats the sticky point, neither the government or insurance companies will actually test and see how good or bad our driving ...

Re: Speed limits
The general principle is that the higher the speed the worse the collision. Absolutely true. However, there is no link between speed and accident occurance. Cars are safer now, radial tires, ABS brakes, crumple zones and airbags, but revenue is still the driving force behind laws. Anyone notice that the plane is back in the sky, 5 months after Bill ...
