hello all ,just got a careless driving ticket. haven't had a ticket in 25 years (yes i know it doesn't change things) anyway i was driving on hwy 8 in kitchener trafic but moving steadly trunk infront just comes to dead stop tried to aviod could not go into right lane cars so tried to go to right hit gaurd rail and than hitt back of truck

You may be able to get this down to invalid sticker only. You did not produce proof of insurance, but you had insurance, so that charge goes out the window.

And, in the future, keep one those insurance folders in the same spot of your car, or wallet. I've almost tripped myself on that one as well.

The plea bargain usually takes place 15 mins before the JP enters the court room and during the break.
In many cases the Crown will offer a lower charge, if the Crown does not you can initiate the plea bargain. Don't forget to check for the cop's presence before taking the Crown's offer.

If the new trial is close to a year from the offence date you can file for a stay based on a Charter 11b arguement. You can find File Form 4F on http://www.ticketcombat.com . Fill out the form with all of your info and send the copies to all parties involved.

What you had there was the crown trying to push through as many cases as possible ...

yes you can be arrested for 172 offences, but it is not a PON, but rather a summons.
Summons may not be a PON but, you can still receive jail time. The law needs to be cleared up so that the jail time is only for say repeat offenders.

It is still unconstitutional to imprison someone without a trial. Take that out and this law may stand.

the Prosecutors office in Barrie just sent me a letter saying they are having a moition to change trial date on december 1st. My riginal trial date was dec 8th.
IS this legal, can they do this?
do i have to attend?

is there any way to get this thrown out because of this moition.

Regarding the home number error on my ticket, do you think it
can become a fatal error if I choose to "do nothing"?
No luck on that one.

However if you can prove that the light turned yellow the moment you entered the intersection, this ticket is toast.

I have always requested MY continuances with the JP on the day of the trial, not with the Crown 3 days before the trial.

I would just show up on my trial date. If the Crown still hasn't provided the disclosure, I'd motion for dismissal. It the cop doesn't show up, I'd motion for dismissal. It's too late to receive the disclosure in a reasonable ...

I have just received a similar notice. What I don't quite understand is how this proves I have done anything contrary to the HTA.

It seems that the first picture shows my vehicle stopped, behind the stop line, with brake lights on, and my turn signal illuminated.

My vehicle is not visible in the second picture.

The times listed are 0.9 seconds ...

I agree that your job is dangerous and that the public needs to realize what the possibilities are when they are passing an officer and "client".

The problem is that 90-95% of the time there is absolutely bupkiss happening on roads other then people driving to their destination. This lulls us into a false sense of "road bliss" and when something ...

That sounds funny. If an officer motions you to pull over, you have to pull over. You don't "need" to move left then right if he has motioned you over already. The charge you are facing has nothing to do with your going past him when he motioned to you, it has to do with the fact you did not change lanes when he was already stopped.

I have my trial in a court that is six hours drive away from where I live.
If I lose my trial, I am planning to appeal. But I can't go there again within 15 days.

Is it possible if I appeal on the same day (after the trial).
