Re: 8 Month Pregnant Wife Gets Big Ticket on 24
The officer was well within their rights to do what was done. However, the sticking point here may be what speed zone was your wife in when the speed reading was taken? The officer will have to prove which zone, 80, 60 or 50 the vehicle was in to make the speed stick.

Yep. I don't claim to know anything about the device or the manual, so if the procedure she used is different, the evidence from the device should be excluded. However... if I were to take a guess... a zero-velocity fixed distance test seems to be what the officer did do... but I don't know for sure.

Not fact but, with the signed ownership the car is no longer your relatives. This was a trade for services. The other person know of this, however without a lot of paperwork it's hard to prove. The "other" guy did not register it under his name so that leaves your relative to explain the situation to all involved. He may have to get a copy of the ...

The appeal it's self usually has to do with the trial.....and to launch a full appeal you need the transcripts. You don't need the transcripts to file the appeal but you will need them later.Off_Camber wrote:I didnt need to in order to file my appeal as it is a part 1 matter.

For example, the copy may have written in notes that I was following too closely another car before not obeying stop sign.

If the offense (failure to wear seatbelt) occurred 1km away from where the ticket says it did. Is that relevant ?
The officer observed me without my seatbelt at an intersection, I then put it on and he followed me to my house (1km away) and wrote the ticket with the offense occurring on my street.
