I can't possibly agree for a single second that having a high rate of child obesity is a good thing, even if that's the "change" that's being heralded right now. Change is not always good, it's not always bad either.
All these issues are based around stale thinking and poor community infrastructure.

If you don't get the stuff you ask for in disclosure, make another request. If that fails, then file a Notice of Constitutional Question to stay the charge. The JP would probably order an adjournment and charge the delay to the Crown, but it may work and you might get a stay. Just be forewarned, there are only two things you could realistically ...

Is said lazy generation the product of "lazy" parenting? Just asking.
On the subject, it used to be that kids would be out playing all of the time on the streets. They'd make friends in the neighbourhood. You see very little of that now.

Re: Swerved to avoid animal then charged with Careless driving
In most cases swerving to avoid an animal is not the best idea.
Generally, the rule of thumb is this: Stop straight if able. If unable, if the animal is "below the hood," (e.g. raccoon, squirrel), do NOT swerve. Unfortunately, the small animal will get hit. If the animal is "above the hood," (e.g. moose, buffalo), swerve. Otherwise, your hood ...

Re: Swerved to avoid animal then charged with Careless driving
Your insurance might still be affected if the charges are dropped, just because you did crash your car, even if it was to avoid an animal. However, it won't be affected as outrageously as if you get the careless driving conviction. I'd recommend getting professional help with this charge. It carries huge consequences.

My questions is. Did the officer charge me correctly with disobey sign?
or can I argue that it should be Proceed contray to sign directed? or some other charge
In instances like this, both 182 (2) Disobey Sign and 144 (9) Proceed Contrary to Sign at Intersection apply. If the officer wanted to cut you a break (which is what happened to your ...

I'd say choose option 3 on the ticket and start the paperwork to fight it. If nothing else, you can always plea-bargain to a lower speed. Since you've got a reasonable driving record, you might luck out and be able to get 15 km/h over the limit for this particular offence.

BTW, American TV shows have it wrong with the phone call thing. You do NOT have the right to make "one phone call" in the US when you're under arrest. They try to play up the drama with this legendary "one phone call," but it's completely incorrect. (Scenarios like someone trying to decide who they're going to call with this supposed "one phone ...

I'd suggest, at least, choosing option 3... at least that opens the door to different options whether you want to plea-bargain, fight it out in court, etc. The Crown will probably offer 29 km/h over the limit as a plea-bargain. If you're lucky, they may accept 15 over.

The convictions don't drop off the records that police can look at, but they do drop off the driver abstract (and what the insurance companies can look at) after three years, suspensions after five.

Some by-law infractions can carry demerit points, and ones that prohibit turns are, unfortunately, ones that do. However, the municipalities aren't always bang-on with reporting such by-law infractions to MTO, so there's a good chance it will just go underneath their radar screen. If the officer had charged you with Proceed Contrary to Sign at ...

One thing to keep in mind... get your hands on the collision report and any evidence that shows the cab driver blew the red light. This is important, because although you were charged with Careless Driving, insurance will hold the cabbie 100% at fault if the evidence shows he ran the red light. Highway Traffic Act and Insurance Act are two ...

As hwybear says... if the Crown was responsible for both delays, then you could argue for an 11B (unreasonable delay of trial). The court will not consider the re-scheduling of the trial due to your father's passing as part of a "delay" that would factor into an 11B.

Hold up.
If the set fine is incorrect, the procedure to get the ticket quashed is actually to not show up for trial at all. The Ontario Court of Appeal made this clear with the London v. Young ruling. If you show up for trial, the JP can amend the certificate and correct the mistake. If you do not, the JP must examine the ticket to ensure it is ...

I don't get it. Isn't that what salesmen do?
If the guy is a cheap, dirty salesman, then yes... But most of them just want the sale and to be able to make a profit/commission. $66 000 for a $41 000 is total fraud. I mean, it appears that they deliberately tried to take advantage of a person who was probably a bit "developmentally delayed." If ...

You can still use R. v. Sandhu. The premise of Sandhu was that the officer could see the signal, and insisted that it was red. The defendant said it was amber when he entered the intersection. The defendant was found not guilty of Red Light - Fail to Stop, because his testimony was rock-solid and unshaken, in that he did go through the intersection ...

I agree, tuning fork test is not required.
In fact, the officer did a "road test," where he drove down the road and measured the radar readout versus the calibrated speedometer of the patrol vehicle. He did the test on the southbound lanes of highway 10. That's more accurate than a tuning fork would be in any event, so both an internal and ...
