If you don't get the stuff you ask for in disclosure, make another request. If that fails, then file a Notice of Constitutional Question to stay the charge. The JP would probably order an adjournment and charge the delay to the Crown, but it may work and you might get a stay. Just be forewarned, there are only two things you could realistically ...

In most cases swerving to avoid an animal is not the best idea.

Your insurance might still be affected if the charges are dropped, just because you did crash your car, even if it was to avoid an animal. However, it won't be affected as outrageously as if you get the careless driving conviction. I'd recommend getting professional help with this charge. It carries huge consequences.

Try plea-bargaining to a municipal by-law infraction if you want to avoid the insurance issue... If you ask for a municipal "disobey sign" infraction, that would not have points, as well...

I'd say choose option 3 on the ticket and start the paperwork to fight it. If nothing else, you can always plea-bargain to a lower speed. Since you've got a reasonable driving record, you might luck out and be able to get 15 km/h over the limit for this particular offence.

As OPS Copper is indicating... never, ever, lie to the insurance company. They will find out, hopefully before anything happens. If you were to, say, get in a collision, the first thing they do is dig through your records to see if you are/were suspended or there's any reason ...

I'd suggest, at least, choosing option 3... at least that opens the door to different options whether you want to plea-bargain, fight it out in court, etc. The Crown will probably offer 29 km/h over the limit as a plea-bargain. If you're lucky, they may accept 15 over.

The convictions don't drop off the records that police can look at, but they do drop off the driver abstract (and what the insurance companies can look at) after three years, suspensions after five.

Some by-law infractions can carry demerit points, and ones that prohibit turns are, unfortunately, ones that do. As hwybear says... if the Crown was responsible for both delays, then you could argue for an 11B (unreasonable delay of trial). The court will not consider the re-scheduling of the trial due to your father's passing as part of a "delay" that would factor into an 11B.

Best thing to do at this point would be go to court, and see if the officer shows ...

The only issue is that if he doesn't show up and they go for a 9.1 conviction and the JP doesn't notice it then he gets the conviction and has to appeal.

Therein lies the problem... JPs often just rubber-stamp the PON.

Over here, too many people drive at night without turning on their headlights. Their excuse is that the DRL's are giving them enough illumination. They forget about being easy to see from behind.
