Re: Help! Improper Right Turn 141(2) (Victoria and Bracken)

In terms of the fine, the officer's probably referring to plea-bargaining down to a municipal by-law infraction, which would also take care of the demerit points, and it also wouldn't go on your driver record.

Windsor eh? Was this on Riverside Drive at Devonshire Road (right beside the Hiram Walker Plant)?

You may be able to plea-bargain to a municipal by-law infraction with this one, if nothing else. That would give you 0 points, a smaller fine and nothing would go on your driver record.

Re: Fail to report at parking lot

The police officer claimed that he saw the hospital security tapes, but like I said, the parking lot does not belong to the hospital, it belongs to medical center across the hospital. We checked there and I didnt see any security cameras. Can they be hidden so you don't see them, or he might be bluffing??

If he had video evidence, he should ...

Easier to see and easier to gather evidence? See, I think most reasonable people would believe that it would be harder to gauge the distance between two moving vehicles at a height of at least 1000 ft, while the aircraft is humming along at 150+ kph. Im sure any paralegal worth their salt could poke a multitude of holes in any such testimony from ...

Re: 60km/h in a 40km/h and want to fight - need help

You've already gone through the first step, which is setting up the trial date. When you get your trial date, you can then make a disclosure request to see what the evidence is against you. The disclosure request would basically include a copy of the officer's notes, and the relevant parts with the radar (or lidar) manual (testing and use of the ...

There is no additional charge to go to court. The $5 court fee is already included in your total payable.

He was referring to reducing the speed in a plea-bargain, to 15 km/h over the limit. That would give you a total payable of $52.50, if you wanted to go that route...

I think through the use of photos I could prove that the signs are not visible from 60m but does that even matter?

Yes it does. If the signs are not visible from 60m away, they are not enforceable. The thing about photographs is, they must reasonably show the type of scene that you would've encountered at the time the offence was committed ...

I'd say that disclosure is more or less complete for this case... except for parts of the notes. What I'd do is file another request, stating that you cannot read certain parts of the notes, and would like a type-written copy of them. Not sure if Odot has separate written instructions. If they do, and they're substantially different than the manual or require specific things to be done, then it should be disclosed to you.

60 km/h speed limit, day weekends, mostly single marked units, LIDAR. Officers usually sit in parking lots waiting for people to speed by. Road was designed for high speeds and most people speed here.

The definition can be found in Section 1 of the HTA:

"intersection" means the area embraced within the prolongation or connection of the lateral curb lines or, if none, then of the lateral boundary lines of two or more highways that join one another at an angle, whether or not one highway crosses the other;

Now here's the thing... I hope you're ...

I believe that a combination of proper training and enforcement could eventually fix our society's behavior. If training reinforces proper lane discipline/road sharing and enforcement irons out the real wrinkles in our driving habits (instead of just what's easy to prove in court), driving will become safer and ...

I wouldn't go into court against this charge without professional help. Shop around, see who seems the most professional and willing to tackle the case. The consequences of a conviction are quite steep, namely $2000 in fines and 6 demerit points, possible additional licence suspension and a huge insurance increase.

The only way to start the process is to put in the paperwork to fight the ticket... request the trial option & file the notice to appear (which is what you're doing).

At that point, you've at least delayed the conviction going on your record. You could consider trying to plea bargain to 15-over, which would be zero demerit points. They may have a ...

No insurance? Was the vehicle insured at the time or not? I mean, you said you didn't call your insurance company "immediately," but you have up to 7 days to make a claim.

If the vehicle was insured at the time, the "no insurance" charge is easily beaten. Just bring documentation from your insurer to court and they will withdraw the charge against ...

The problem is, all of the provinces and many US states have reciprocity for traffic and parking tickets.

Basically the courts will sent the information back to New Brunswick that your fines are unpaid. New Brunswick will see that you've acquired Ontario licence plates, and forward it to MTO. When MTO gets the information, they will not renew your ...
